Question:
From Makkah al-Mukarramah, Wadi Fatimah, a message was sent by one of the listening brothers, whose name was indicated by the letters (M. H. H). He says: A man catches up with the imam in the second rak'ah of Maghrib, and sometimes in the second rak'ah of Fajr. Consequently, he will have prayed three times for the tashahhud in Maghrib, and twice in Fajr. What should he do with the extra sitting? How is it detailed? And what is the ruling on one who recites the tashahhud in it?

Answer:
This sitting is following the imam. It is the sitting he does after the first rak'ah that he caught up with, which is the second rak'ah in the imam's count. This is a following sitting, a sitting that follows the imam. He sits following the imam. And so it is in Maghrib, in Fajr and Maghrib, this is following. And so, if he catches up with a rak'ah of Zuhr, or 'Asr, or 'Isha', he sits after he prays the first rak'ah that he makes up. He sits for the tashahhud, then he stands and prays the two that he missed.
So the result is: this rak'ah that he caught up with the imam in, in Fajr, or in Maghrib, he sits in it a sitting with the imam, following the imam. And if he recites the tahiyat in the first tashahhud, and the prayer upon the Prophet (peace and blessings be upon him), following the imam; then there is no blame on him. And if he does not recite it, there is no blame on him; because this is not a sitting in his right. It is not in the first tashahhud, nor in the last tashahhud. But if he recites it following the imam; then this is good -if Allah wills- and it does not harm him. And what is obligatory upon him is the last sitting, which is after making up the rak'ah that he missed in Fajr, and after making up the two rak'ahs in Maghrib. He has the last tashahhud, the last tashahhud and the first tashahhud after he brings two rak'ahs in Maghrib, in the first tashahhud. His sitting with the imam is only following.
And the sitting that is obligatory upon him is after he makes up a rak'ah of Maghrib, he sits for the first tashahhud, then he prays the third, and he sits for the last tashahhud. And in Fajr, he makes up the rak'ah that is upon him, and he sits for the tashahhud that is obligatory upon him, which is the tashahhud in which is the salam. This is obligatory upon him.
As for his sitting with the imam, it is not obligatory upon him except following the imam. He sits following the imam, and it is not obligatory upon him to recite the tashahhud in it. But if he recites it; then there is no blame. Yes.
