Question:
The listener Ahmad Abdulrahim Umar from Cairo in the Arab Republic of Egypt sent a message containing a collection of questions. In one of his questions, he says: In the 'Asr prayer, the imam did not sit for the middle tashahhud, so the worshippers alerted him by saying Subhan Allah. After he stood up for the third rak'ah, he returned and sat for the tashahhud. After the final tashahhud, he prostrated two prostrations of forgetfulness and then said the taslim. Some disagreement arose in the mosque; some said his prayer was valid, while others said it was not valid because he returned from an obligatory act to a recommended one. Some of the worshippers began to repeat the prayer. What is your opinion, and we ask for information regarding cases of forgetfulness, and when the prostration of forgetfulness is before the taslim and when it is after? May Allah reward you with good.

Answer:
If the imam stands up from the first tashahhud while forgetting, then he is alerted and becomes aware, and he returns, there is no blame on him. The ma'mums should return, sit with him, and perform the tashahhud. He should pray and prostrate two prostrations for forgetfulness before the salam. The Prophet (peace and blessings be upon him) did this, for he stood up from the first tashahhud in some of his prayers, then prostrated two prostrations before he said the salam (peace and blessings be upon him). However, if this imam had fully stood up, it is better for him not to return. But if he does return, there is no blame on him, and they should return with him. His prayer is valid, and there is no need to repeat it in this case.
As for if he has begun the recitation, he does not return. He continues and prostrates for forgetfulness after he finishes the tashahhud and supplication. He prostrates for forgetfulness before he says the salam, as the Prophet (peace and blessings be upon him) did. If he returns while ignorant of the ruling, even if he has already begun the recitation while ignorant of the ruling and returns, his prayer is valid. He is excused due to ignorance, and they should return with him, so they perform the tashahhud, then stand up with him when he stands.
The principle in these matters is that it is obligatory for the ma'mums to follow the imam, emulate him, and not contradict him except with certainty, knowing that following him is not permissible. For example, if he stands up for a fifth rak'ah and they know it is the fifth, they do not stand with him. Or if he stands up for a fourth rak'ah in Maghrib and they know it is the fourth, they do not stand with him. Or if he stands up for a third rak'ah in Fajr or Jumu'ah and they know it is the third, they do not stand. As for the one who does not know, he follows his imam who does not know; he follows his imam.
As for the prostration of forgetfulness, it is before the salam. This is the recommended practice before the salam, because it is part of the prayer, except in two cases:
The first is if he says the salam due to a missing rak'ah or more. In that case, he prostrates for forgetfulness after the salam. This is the best. He prostrates after the salam because the Prophet (peace and blessings be upon him), when he said the salam due to a missing two rak'ahs in the hadith of the man with the two hands from the hadith of Abu Hurayrah, prostrated after the salam. Likewise, in the hadith of Imran, when he said the salam due to a missing rak'ah, he completed his prayer and prostrated after the salam. This is the best. And if he prostrates before the salam, it suffices, praise be to Allah.
The second case: if he builds his action on his predominant opinion, if he seeks the truth, exerts effort, and builds on his predominant opinion, then he prostrates after the taslim; this is the best; due to the hadith of Ibn Mas'ud (may Allah be pleased with him) in the two Sahihs that the Prophet (peace and blessings be upon him) said:
when any of you is in doubt about his prayer he should aim at what is correct and complete his prayer in that respect, then give the salutation and afterwards make two prostrationsإذا شك أحدكم في الصلاة؛ فليتحر الصواب، فليتم عليه، ثم ليسلم، ثم يسجد سجدتين
