Question:
This questioner says: It is well known that in Surat al-Tawbah, neither the seeking of refuge nor the Basmalah is recited at the beginning. Does this mean that we should seek refuge in Allah from the accursed Shaytan after the first verse, or not? Please guide us. May Allah reward you with good.

Answer:
When the Companions (may Allah be pleased with them) compiled the mushaf in the time of 'Umar ibn al-Khattab, they did not write the line "In the name of Allah, the Most Merciful, the Most Compassionate" between al-Anfal and al-Bara'ah. This was because 'Umar and a group of them were uncertain whether it was part of al-Anfal or separate. Was al-Anfal and al-Bara'ah one surah or two? Therefore, they did not write the line "In the name of Allah, the Most Merciful, the Most Compassionate" between them. So, when a person begins with al-Tawbah, he seeks refuge in Allah from the Shaytan only, saying: "I seek refuge in Allah from the accursed Shaytan," and this is sufficient at the beginning before he says:
[This is a declaration of] disassociation, from Allahبَرَاءَةٌ مِنَ اللَّهِ
[al-Tawbah:1]; due to the saying of Allah (Exalted and Majestic is He):
So when you recite the Qur'an, [first] seek refuge in Allah from Satan, the expelled [from His mercy].فَإِذَا قَرَأْتَ الْقُرْآنَ فَاسْتَعِذْ بِاللَّهِ مِنَ الشَّيْطَانِ الرَّجِيمِ
[al-Nahl:98].
However, if it is continuous; if he recited al-Anfal and then began with al-Bara'ah, he does not need to seek refuge, nor say anything; because the recitation is continuous. He finished al-Anfal, then started with al-Tawbah. There is no need for the Basmalah, nor "I seek refuge in Allah from the accursed Shaytan"; because the Basmalah was not prescribed in it, and he is now continuing in the recitation, not beginning. But if he begins with al-Tawbah, starting the recitation with al-Tawbah; he begins with seeking refuge in Allah from the accursed Shaytan. Yes.
