Question:
I am a guardian over some orphans, and they have a sum of money. I am engaged in trade with it, and at times I need some of it, so I take a good loan from it. Is it permissible for me to take anything from it?

Answer:
In the name of Allah, and may peace and blessings be upon the Messenger of Allah. The most cautious course for you, my brother, is not to take; for a person may become lax regarding what is in his hands on behalf of the orphans. You should borrow from others, and strive to grow their wealth and improve their affairs. However, if you are in need, as Allah the Exalted said:
And whoever, [when acting as guardian], is self-sufficient should refrain [from taking a fee]; and whoever is poor - let him take according to what is acceptable.وَمَنْ كَانَ غَنِيًّا فَلْيَسْتَعْفِفْ وَمَنْ كَانَ فَقِيرًا فَلْيَأْكُلْ بِالْمَعْرُوفِ
[Surat al-Nisa: 6], then if you are in need, you may eat in a reasonable manner. The most cautious course for you is to agree with the legal authority—the judge—on a known amount for your effort. Otherwise, leave it; for if you borrow from their funds, it may be delayed with you and remain stagnant, and there is no one to demand it from you. So the most cautious course for you is not to take a loan from their funds. As for your effort, there is no harm in taking something for your effort through the court; you agree with the court on a certain amount.
