The Ruling on Marrying a Man Who Neglects Zakah and Hajj

Question:
Our sister’s last question is this: If a man prays, but does not pay zakah, and does not perform Hajj, even though he is able to perform Hajj, is marriage to him valid?

Answer:
It is valid, but he is a sinner. He is considered a sinner if he does not fast Ramadan, or does not pay zakah. Some scholars have gone so far as to declare him a disbeliever, so he is in great danger. One should be cautious of that.
The correct view is that he is not declared a disbeliever for this, provided he does not deny the obligation of zakah, does not deny the obligation of fasting Ramadan, and does not deny the obligation of Hajj when one is able to perform it. He is a sinner and an open sinner. He must repent to Allah, and he must hasten to pay the zakah for the past, and hasten to make up the fast of Ramadan if he left any of it, and likewise hasten to perform Hajj if he is able.
As for the one who leaves off prayer, he is declared a disbeliever according to the correct view, even if he does not deny its obligation. We ask Allah for safety. Yes.
