Clarification of Some Beliefs and Ideas of This Group, the Party of Liberation?

Machine translationRead the Arabic original
The Shaykh : And one of their tragedies in reality, in my view, is that if a party member has not adopted a secondary opinion that is decisive, for example, they hold that the Muslim woman votes and is elected, so if one of them discusses this with them and rejects the opinion, he is expelled. And among their serious issues is that any opinion stated by a scholar of the Muslims, no matter how far it is from the truth, no matter how much it contradicts the evidence of the Sunnah and the Book, is an Islamic opinion, meaning it is permissible to adopt it and act upon it. They proceed on this basis, and this is a principle they establish to justify what? Their scientific conduct.

The questioner : Is this written?

The Shaykh : Yes, this is written in the issue that any opinion stated by a scholar is an Islamic opinion; this is written among them.

The questioner : There was a discussion...

The Shaykh : By Allah, there were many discussions, I do not remember, I remember... we gathered in it, in al-Rusayfah?

The questioner : Yes.

The Shaykh : Al-Rusayfah, but I remember the discussion that took place in prison regarding this same article. I did not read this article in the book; it is in a bulletin, what do they call it? A special bulletin among them. So, I did not know from my previous studies that this was their opinion, but I did not know that they made it a system and a guide for the community until I was in prison. It is published among them in a special bulletin. So, a discussion took place between me and one of them, who is from Homs. I said to him, essentially, what is your opinion regarding intoxicants in their various types and many names? Are you not with us that, as he (peace be upon him) said:
Every intoxicant is Khamr (wine) and every Khamr is unlawful. كلُّ مسكرٍ خمرٌ ، وكلُّ خمرٍ حرامٌ
Sunan Ibn Majah 3390Hasan (Darussalam)
. He said: Yes. I said to him, do you have no doubt at all? He said: No. I said to him, but some of the great, great scholars of the Muslims hold the opposite of what this hadith states. They hold that the intoxicant extracted from grapes, whether little or much, is forbidden. But what did I say!

The questioner : The intoxicant extracted from grapes?

The Shaykh : Yes, but as for the intoxicant—I feared I might have made a mistake, sister, the error you pointed out to me—as for the intoxicant extracted from other than grapes, the much of it is forbidden and the little of it is not forbidden. And the much is that which intoxicates. So if a person drinks until he becomes intoxicated from the intoxicants extracted from other than grapes, that is the forbidden thing. But if he drinks a small cup or two cups and does not become intoxicated, that is lawful. I said to him: And you say that the caliph—the Muslim ruler—settles the disagreement. So if he adopts an opinion, it is obligatory for all Muslims to submit to this opinion. And this, I think you remember now, the Islamic writers use this weapon and place it in the wrong place.

The questioner: Correct.

The Shaykh : Note...

The questioner : ... Islamic, and this is a problem.

The Shaykh : This is a very, very serious matter.

The questioner : Very serious.

The Shaykh : Yes, yes.

The questioner : I hope, essentially, that you write about it or speak about it.

The Shaykh : I wish I could. As for speaking, we speak. But as for devoting ourselves to writing the issues, unfortunately, I am not able. The point is: They say: If the ruler adopts an opinion, he removes the disagreement and submission to it is obligatory. I said to him: So if a Muslim ruler comes and adopts an Islamic opinion and says: The much of the intoxicant from other than grapes is forbidden and the little is lawful. So on this basis, it is permissible to sell it, other than grape wine. We need to define the goods. Wine from grapes is forbidden to sell, buy, or drink a drop of it. But the intoxicant extracted from barley, corn, and so on, this is another ruling. And if one drinks from it and does not become intoxicated, it is permissible and lawful. Has this opinion been established, so-and-so? If we establish it, this Muslim ruler... He said: Yes. I said to him: Where do you put his (peace be upon him) saying:
A creature is not to be obeyed when it involves disobedience to the "Creator.” لا طاعة لمخلوق في معصية الخالق
Mishkat al-Masabih 3696
? Do you know how this hadith was interpreted? He said: There is no obedience to a created being in disobedience to the Creator, in a disobedience that the one obeyed believes is disobedience, not the one obeying. Do you understand how? Meaning, if the ruler orders you to do something and the ruler himself believes it is forbidden, it is not permissible for you to obey him; it is forbidden. But if he orders you to do something he considers permissible and lawful, and it is forbidden for you, it is lawful for you. Matters that threaten Islam from its root, from its foundation. And they have not even reached ruling yet. What do you think? These are his ideas and these are his opinions. And we ask Allah for safety. We were gathered for about a month in the house of one of them to get to know them... and we found some soundness in them. From that, he grew his beard. The Party of Liberation is very few, meaning if you see a person—I have a rule now—if you see a person speak about Islamic matters, say about him that he is a party member as long as he is shaved, because of the scarcity of what? Those who follow this Sunnah. So, after we got to know him there, and he started attending some of our lessons and our preaching and reminders, praise be to Allah, he grew his beard. His father passed away. Not his father who had passed away before, or another?

The questioner : A relative of his.

The Shaykh : A close relative, essentially, meaning we consoled him. We spoke, praise be to Allah, except for the Islamic state. My brother, the taverns and the open sinfulness and lewdness, and this cannot be dealt with except by what? Except by the Muslim state. By Allah, it is true. But what is the way to establish the Muslim state? If we, I like this phrase very much—I mention it a lot—“Establish the state of Islam in your hearts, and it will be established for you on your land.” I say, if we do not establish the small state in our homes, where can you establish the big state? Answer with enthusiasm like this, and so on. And I was sitting in a gathering in a large room, a salon, and every now and then I would see a picture hanging of a woman in the French style, a wide dress, naked, hanging. I said to him: So-and-so, you want to establish the Muslim state? Turn this picture over, right here, this image. He said: This is not mine, and I don't know what it is. He went and turned it over. I said to him: You turn it over, but someone else will turn it over. Is this how the establishment of the Muslim state is done? So, in terms of upbringing, they have no care. From here, they differ completely from the Muslim Brotherhood. They do not even explicitly state here regarding morals. They criticize Shawqi when he said:
“Nations are but morals, as long as they remain *** If their morals go, they go”
He said this statement is not sound. It is a strange thing, meaning. So, glory be to Allah. They are enthusiastic and have ideas. And in terms of seeking help from the disbelievers, they call it support. They take a hadith that occurred during the time of the Messenger (peace be upon him) regarding... the Islamic power, although this is contrary to the rule established by the Messenger (peace be upon him) himself when he said:
We do not want any help from a polytheist. إنَّا لا نستعين بمشرك
Sunan Abi Dawud 2732Sahih (Al-Albani)
. So they reversed the rule and built their party on what? Seeking support. And perhaps you know that in some of their stages, the call may be seeking support for Iraq, or they wanted to seek it. They do not hesitate from this, no matter what.

The questioner : ... .

The Shaykh : ... Yes.

The questioner : Their evidence, excuse me, the evidence they rely on?

The Shaykh : Some incidents occurred in the biography, and the Messenger (peace be upon him) sought help from some polytheists.

The questioner: Yes.

The Shaykh : But I am saying the Messenger was in special circumstances, and it was in the height of the strength of the state and the might of the Muslims, meaning although he said:
We do not want any help from a polytheist. إنَّا لا نستعين بمشرك
Sunan Abi Dawud 2732Sahih (Al-Albani)
. Another incident: A man from the Muslims came to fight with him, and he said to him:
Go back; for we do not seek help from a polytheist ارجع ؛ فإنَّا لا نستعين بمشرك
Sahih Ibn Hibban 23:260
. So here they reversed the issue from two sides: First: They did not notice the difference between the weakness of today, or the weakness of the Muslims in general, and the strength of the Muslims in that era. So the scope of speech, meaning the reality, is wide in this issue. In any case, we ask Allah to guide all our Muslim brothers to what is good and right. And perhaps this extent is sufficient.

The questioner : May Allah reward you with good.

The Shaykh : And to you.

The questioner : And the truth is, this is a happy opportunity.

The Shaykh : May Allah make you happy in this world and the Hereafter.

The questioner : And we ask Allah that the youth benefit from what I said.

The Shaykh : May Allah bless you.

The questioner : And that He may bless your life and benefit through you.

The Shaykh : May Allah preserve you. Also, we thank you because you provided us with the clarification of some truths that many people are unaware of.

The questioner : ... .

The Shaykh : Yes, there is no difference between.
