Question:
I have a sister whose son died in a car accident. He left behind no wealth other than the pension he was receiving, which his father collects. He did not give his mother anything.

The Shaykh: Repeat.

The presenter: She says: I have a sister whose son died in a car accident and left behind no wealth other than the pension he was receiving, which his father collects. He did not give her anything so that she could give charity on his behalf. When she says, "Give charity on his behalf," he says, "If you do that, she does not own any wealth to give charity from." Is she sinful for that? And what should she do?
May Allah reward you with good.

Answer:
She owes nothing, and there is no harm in that. There is nothing required of his father if he does not give charity on his behalf. They are in greater need of charity. If they are poor, they are in greater need of the pension so that they can eat, they and their children. If it becomes easy for them to give charity on his behalf from their own wealth, even if it is a little, then charity benefits the deceased. However, charity is not obligatory if he did not bequeath anything, so charity is not obligatory.
As for if he bequeathed something from his wealth, if he had wealth and bequeathed something up to one-third, his bequest is executed. As for if he did not bequeath anything, then nothing is required of the mother, and nothing is required of the father. The pension of the deceased belongs to the heirs, to his father and the heirs with his father, to his father and his mother. If he had children, then his children have their share, and his wife has her share of the pension. If the state allocated it to some of them, allocated it to his father alone, or allocated it to his mother or to his father and his mother, the state looks into that. Yes.
