Question:
The following message was received by the program from Libya. The sender included more than one issue in his message. One of the issues is that he incurred a large amount of expense in the marriage, and despite a long period of time passing, he has not been able to pay the remaining balance of the mahr to his wife's father. He asks: Is he required to fulfill everything in that contract, and does his uncle have the right, according to the Shari'ah, to demand that he pay that amount? And the sender of the message is from Libya?
Answer:
The Prophet (peace and blessings be upon him) said in the authentic hadith:Bulugh al-Maram 8:32 So it is obligatory for you to fulfill what you committed to, and the money that was stipulated for you, unless her father permits it and bears the burden, or she forgives her right. If she forgives it, or her father forgives it, then praise be to Allah.
As long as they are demanding their right, you must fulfill it if you are able. [Al-Taghabun:16] Allah the Exalted says: [Al-Baqarah:280] If you are in difficulty, they must grant you a delay. But if you are well-off, it is obligatory for you to fulfill what you committed to, and by which you made lawful the woman's private parts, due to the saying of the Prophet (peace and blessings be upon him): Bulugh al-Maram 8:32 It is agreed upon as authentic. May Allah guide them all. Yes.
The presenter: O Allah, amen. May Allah reward you with good.

The Prophet (peace and blessings be upon him) said in the authentic hadith:
The most worthy conditions to be fulfilled are those by which you make sexual intercourse lawful for yourselves (in marriage).
إن أحق الشروط أن يوفى به ما استحللتم به الفروجAs long as they are demanding their right, you must fulfill it if you are able.
So fear Allah as much as you are able
فَاتَّقُوا اللَّهَ مَا اسْتَطَعْتُمْAnd if someone is in hardship, then [let there be] postponement until [a time of] ease
وَإِنْ كَانَ ذُو عُسْرَةٍ فَنَظِرَةٌ إِلَى مَيْسَرَةٍThe most worthy conditions to be fulfilled are those by which you make sexual intercourse lawful for yourselves (in marriage).
