Question:
The first message in this episode is one that reached the program from Iraq, sent by one of the listeners there. She says: Umm Najm, Umm Najm has two cases. In the first case, she says about herself: I am a married woman, and I pray and fast, and I am fully devoted to worship. My husband, however, is not on the same path as I am, as he drinks intoxicants and does what is forbidden, and everything that Allah has prohibited. I have children from him, and I tried to reform him, so he turned to the right path for less than a year, where he prayed and fasted. But he returned to what he was doing before. I am trying again to reform him, myself and my children, but to no avail. So I ask you: Do I get credit for my prayer and fasting? Or do I bear sin with him? This is the first question, and the second one I will provide after I hear this answer. May Allah reward you with good.

Answer:
In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, and may Allah send prayers and blessings upon the Messenger of Allah, and upon his family and his Companions, and upon those who follow his guidance. As for what follows:
It is obligatory for you, O questioner, not to remain with this husband. We ask Allah for guidance for us and for him, and success for sincere repentance, as long as he is in this state and does not pray. For the one who does not pray is considered a disbeliever, in the most correct of the scholars' opinions, with major disbelief. Therefore, it is not permissible for you to remain with him; rather, you must avoid him, be cautious of him, and not allow him access to you. It is also obligatory not to consider him a husband until he repents to Allah from what he is doing, which is leaving the prayer, and other things that are considered disbelief.
As for what concerns drinking intoxicants, this is a major sin. For intoxicants are among the major sins. It is obligatory for him to repent to Allah from that. And you have the choice if he prays, and is upright in prayer, and leaves what necessitates his disbelief. You have the choice: if you wish, you remain with him, and if you wish, you seek divorce, as long as he consumes intoxicants. Because it is a major defect, and a danger to you and your children. We ask Allah for guidance for us and for him, and a return to the right path. Yes.
