Question:
Among the questions from the questioner from Kenya, he says: O His Eminence the Shaykh! (may Allah preserve him), if a Muslim or a disbeliever dies, and one of them owes a debt to the other, how do they settle it between them on the Day of Resurrection?

Answer:
The heirs must pay the debt. If they do not pay it on his behalf, their case is left to Allah on the Day of Resurrection. This is left to Allah (Exalted and Majestic is He). But the Prophet (peace and blessings be upon him) said:
Whoever accepts other people's wealth intending to pay it back, Allah will pay it back for him. And whoever accepts it intending to waste it, Allah, the Most High, will waste (destroy) him.من أخذ أموال الناس يريد أداءها أدى الله عنه، ومن أخذها يريد إتلافها أتلفه الله
Bulugh al-Maram 7:94
So their case is left to Allah (Exalted and Majestic is He). However, if he left behind an estate, the heirs are obligated to pay the debt on his behalf.
