Question:
From the questions of this questioner from Yemen, Abu al-Fadl, he says: Your Eminence, what is the stronger position regarding the waiting period of a woman whose husband has died? I mean here the pregnant woman? With an explanation of the most important rulings on mourning, because in this time, there has been negligence and excess, and negligence is the prevailing tendency, so we ask your Eminence for guidance.
Answer:
The waiting period of a woman whose husband has died is four months and ten days, one hundred and thirty days, if she is not pregnant. As for the pregnant woman, her waiting period is the delivery of the child. Allah the Exalted says: [Al-Talaq:4]. So if she dies today and gives birth tomorrow, she exits the waiting period. If it is after that by one day, or two days, she exits the waiting period; because Allah the Exalted says: [Al-Talaq:4].
A woman known as Subay'ah al-Aslamiyyah came to the Prophet (peace and blessings be upon him) and informed him that her husband had died recently, and that she had exited her waiting period. He permitted her to do so, when some people criticized her for it, and informed her that her waiting period ended from the moment she delivered the child. This is the legal ruling: whenever she delivers the child, she exits the waiting period. And there are five matters upon the woman in mourning:
She must stay in the house in which her husband died and in which she was residing.
And she must not wear beautiful clothes, only ordinary clothes.
The third: she must avoid perfume.
The fourth: she must avoid jewelry of gold, silver, and the like, adornments.
The fifth: no kohl. This is the obligatory part of mourning. Yes.
The presenter: May Allah reward you and bless you.
