Machine translationRead the Arabic original
Question:
The listener Muhammad 'Ayd Nasir al-Qahatani from Thulayth sent a message containing a collection of questions. In one of them, he says: There are some people who say, "By the life of the Prophet," during their conversation. Is this permissible or not? May Allah reward you with good.

Answer:
Swearing by other than Allah is not permissible, neither by the prophets nor by anyone else, according to the scholars. In fact, according to all the scholars. Ibn 'Abd al-Barr (may Allah have mercy on him), Abu 'Umar Ibn 'Abd al-Barr, the Maghribi scholar of the Numayr family, reported the consensus of the scholars that shaving the beard... I repeat his question... I repeat his question...

The presenter: He says: There are some people who say, "By the life of the Prophet," during their conversation. Is this permissible?

The Shaykh: Yes, "By the life of the Prophet (peace and blessings be upon him)" is an abomination and is not permissible. Swearing by other than Allah, whoever it may be, whether by the prophets or by anyone else, is not permissible. Abu 'Umar Ibn 'Abd al-Barr (may Allah have mercy on him), the famous scholar al-Qurtubi (may Allah have mercy on him), reported the consensus of the scholars that swearing by other than Allah is not permissible. The evidence for this is what is established in the authentic hadiths from the Messenger of Allah (peace and blessings be upon him), who said:
Whoever has to take an oath should swear by Allah or remain silent.من كان حالفًا فليحلف بالله، أو ليصمت
Sahih al-Bukhari 2679
The other wording is:
He who must take an oath, may do so by swearing in the Name of Allah or he should remain silent.من كان حالفًا فلا يحلف إلا بالله، أو ليصمت
Riyad as-Salihin 1707
And he (peace and blessings be upon him) said:
whoever swears by anything other than Allah has committed an act of shirk.من حلف بشيء دون الله فقد أشرك
Musnad Ahmad 329Sahih (Darussalam)
Imam Ahmad (may Allah have mercy on him) narrated it from the hadith of 'Umar ibn al-Khattab (may Allah be pleased with him) with a sound chain of narration.
And in Sunan Abu Dawud and al-Tirmidhi (may Allah have mercy on both of them), from Ibn 'Umar (may Allah be pleased with them both), from the Prophet (peace and blessings be upon him), that he said:
He who swears by anyone or anything other than Allah, has indeed committed an act of Kufr or Shirkمن حلف بغير الله فقد كفر، أو أشرك
Riyad as-Salihin 1711
.
So swearing by other than Allah is among the great abominations and among the forbidden acts of disbelief, but it is minor disbelief and minor shirk (associating partners with Allah). Therefore, one must beware of it, and a person should not swear except by Allah alone . He should not swear by the prophets, nor by trust, nor by his father, nor by the honor of so-and-so, or the like of that.
The Prophet (peace and blessings be upon him) said:
He who swears by Amanah (faithfulness) is not one of us.من حلف بالأمانة فليس منا
Sunan Abi Dawud 3253Sahih (Al-Albani)
So a person should not say, "By the life of the Prophet," or "By your life," or "By your honor," or "By trust." All of this is not permissible. It is obligatory to swear by Allah alone , because it is an act of exalting, and Allah is the one who is worthy of all exalting . And because He is the Knower of the unseen, He knows the truthful from the liar, so He rewards the truthful with what he deserves and the liar with what he deserves. Therefore, one does not swear except by Him . Yes.

The presenter: May Allah reward you with good.
