Question:
In his second question, he asks: Or is it permissible to swear by the Messenger (peace and blessings be upon him)?

Answer:
It is not permissible to swear by other than Allah, neither by the Messenger (peace and blessings be upon him) nor by any other of His creation. This is a unique attribute of Allah; He is the One who swears by whatever He wills, as He swore by the Mount, the sky with its constellations, the night when it covers, and others.
As for the created being, he has no right to swear except by Allah alone, because swearing is an act of exaltation, which is not fitting for anyone but Allah, and He is the One who knows the secret of the servant, his truthfulness, and his lying, and He is the One who rewards for truthfulness and lying. For this reason, it is authentically reported from the Messenger of Allah (may Allah's prayer and peace be upon him) that he said:
Whoever has to take an oath should swear by Allah or remain silent.من كان حالفًا؛ فليحلف بالله، أو ليصمت

In Musnad Ahmad, with a sound chain of narration, from 'Umar ibn al-Khattab (may Allah be pleased with him), from the Prophet (peace and blessings be upon him), that he said:
whoever swears by anything other than Allah has committed an act of shirk.من حلف بشيء دون الله؛ فقد أشرك

In the Sunan—Sunan Abu Dawud and Sunan al-Tirmidhi—with a sound chain of narration, from 'Abdullah ibn 'Umar ibn al-Khattab (may Allah be pleased with them both), from the Prophet (peace and blessings be upon him), that he said:
He who swears by anyone or anything other than Allah, has indeed committed an act of Kufr or Shirkمن حلف بغير الله؛ فقد كفر، أو أشرك
