Question:
He says: We know that the expiation for zihar is freeing a slave, or fasting for two consecutive months, or feeding sixty poor people, and Allah ﷽ says at the end of the verse:
before they touch one anotherمِنْ قَبْلِ أَنْ يَتَمَاسَّا
[Al-Mujadilah: 3] If touching occurs before the expiation, what is the ruling?

Answer:
The expiation is obligatory upon him; the expiation becomes specific after he has had intercourse with her, it becomes specific then. As for before that, it is not specific. Whenever he intends, he performs it, and if he divorces her before performing it, there is nothing upon him, or if she dies. But if he has intercourse with her, the expiation becomes obligatory upon him, and it is in a specific order. He is not given a choice. First is freeing a slave; if he is unable, he fasts for two consecutive months; if he is unable, he feeds sixty poor people before he touches her, in the order as Allah ﷽ ordered it. First is freeing a slave if it is easy for him; if he is unable, he fasts for two consecutive months, sixty days; if he is unable, he feeds sixty poor people, thirty sa' (a dry measure of about 3 kg), where each poor person receives half a sa' (a dry measure of about 3 kg), before he touches her.
So if he has intercourse with her, and he hastened and had intercourse with her, the expiation becomes obligatory upon him, and he must repent to Allah for that; because he hastened, he must repent and feel remorse out of fear of Allah ﷽ and out of reverence for Him. The expiation becomes specific upon him at that time. If he is able, he frees a slave; if he is not able, he fasts for two consecutive months, sixty days; and if he is unable, he feeds sixty poor people, even if she dies, even if he divorces her. Yes.
