The ruling on one who swears by zihar to abandon a sin and then returns to it

Question:
This (Al-Mahdi H. A.) sent a set of questions. In the first question, he says: I committed a sin and swore that if I returned to this sin a second time, my wife would be to me like the back of my mother. But I did return to it a second time. The question is: Does this constitute zihar? And what is the expiation, O Shaykh?
Answer:
Yes, if you said this and then returned to the sin, you have committed zihar with her. You owe the expiation for zihar. Do not approach her and do not touch her until you free a slave. If you are unable to do so, fast for two consecutive months, sixty days. If you are unable to do that, feed sixty poor people. This is the expiation for zihar. This action is not permissible for you; this is what is not permissible. Allah has named it an ugly word and a lie.
It is obligatory for you to guard against such oaths that involve zihar and the declaration of your wife as forbidden to you. But when you do this and say, "If I do this, my wife is to me like the back of my mother, she is forbidden to me," it becomes zihar. You must avoid her and abstain from her until you pay the expiation for zihar, which is freeing a slave. If you are unable to do so, fast for two consecutive months, sixty days. If you are unable to do that, feed sixty poor people, each poor person receiving half a sa' (a dry measure of about 3 kg), approximately one and a half kilograms, before you approach her, as Allah has specified this in His Noble Book in Surat al-Mujadilah. Yes.
The presenter: May Allah reward you with good.
