Question:
The questioners in this question say: We are a group of young men from the Arab Republic of Egypt, residing in the Kingdom and working for a period of approximately twelve hours, an evening shift from seven in the evening until seven in the morning. At times, we miss the midday prayer, especially on Friday. This night shift is continuous, which results in our sleeping during the day for long periods. What should we do in this regard? And do we sin by leaving the Friday prayer and the midday prayer?

The Shaykh:
Yes, it is obligatory for you to pray the Friday prayer and to pray the midday prayer with the people. It is not permissible for you to agree to work that prevents you from doing so. There is no obedience to a created being in disobedience to the Creator. The Prophet (peace and blessings be upon him) said:
A creature is not to be obeyed when it involves disobedience to the "Creator.”إنما الطاعة في المعروف لا طاعة لمخلوق في معصية الخالق
Mishkat al-Masabih 3696
. Therefore, it is obligatory for you to pray the Friday prayer and to pray with the people. Your employer must allow you to do so, and the prayer times must be excluded. The prayer times must be excluded; this is obligatory for you and for your employer.
It is not permissible to be lenient in this matter; rather, you must pay attention to it and stipulate with him that the prayer times are excluded, because it is an obligation upon everyone. Allah, Exalted and Majestic is He, says:
Maintain with care the [obligatory] prayersحَافِظُوا عَلَى الصَّلَوَاتِ
[al-Baqarah: 238], and He says:
And establish prayer and give zakah and bow with those who bow [in worship and obedience].وَأَقِيمُوا الصَّلاةَ وَآتُوا الزَّكَاةَ وَارْكَعُوا مَعَ الرَّاكِعِينَ
[al-Baqarah: 43]. And the Prophet (peace and blessings be upon him) said:
Whoever hears the call for prayer and and does not come (to the mosque for prayer), his prayer will not be accepted from him, unless he has a (legitimate) excuse.من سمع النداء فلم يأت فلا صلاة له إلا من عذر
Bulugh al-Maram 2:308
. It was asked of Ibn Abbas, "What is the excuse?" He said, "Fear or illness."
And there is the hadith of the blind man who said, "O Messenger of Allah! I have no guide to lead me to the mosque. Do I have a dispensation to pray in my house?" He said:
Do you hear the call to prayer?هل تسمع النداء بالصلاة؟
Sahih Muslim 653
He said, "Yes." He said:
Then respond.فأجب
. The blind man who had no guide was ordered to respond, seeking someone to lead him until he reaches the mosque. Yes.
