Question:
The questioner, Umm Khalid from al-Bahah, we reviewed a question from her, and in this question she says: I perform witr before sleeping out of fear that I might fall asleep and not perform witr; following the saying of the Prophet (peace and blessings be upon him):Jami` at-Tirmidhi 453Da'if (Darussalam) And if it happens that I get up before Fajr, I pray four or six or whatever number of rak'ahs is easy for me, but I do not perform witr; because I have already performed witr before sleeping. Is my practice correct?
Answer:
Yes, this practice is correct. If a person fears that he will not get up at the end of the night, he performs witr at the beginning of the night. And if Allah makes it easy for him to get up at the end of the night, he prays whatever is easy for him, two or four or six or more, saying the closing salam after every two. The Prophet (peace and blessings be upon him) said:Sahih Muslim 755a.
The Prophet (peace and blessings be upon him) advised Abu Hurayrah and Abu al-Darda to perform witr before sleeping. So, performing witr before sleeping is a matter of prudence if one fears that he will not get up at the end of the night. As for one who has confidence, or who is likely to get up at the end of the night, witr at the end of the night is better. And if one performs witr at the beginning of the night and then Allah makes it easy for him to get up at the end of the night, he prays whatever is easy for him in pairs of two, and he does not repeat the witr. The first witr is sufficient.

If anyone is afraid that he may not get up in the latter part of the night, he should observe Witr in the first part of it; and if anyone is eager to get up in the last part of it, he should observe Witr at the end of the night, for prayer at the end of the night is witnessed (by the angels) and that is preferable.
