Warning Against Building Mosques on Graves

In the name of Allah, and all praise is due to Allah, and may Allah’s blessings and peace be upon the Messenger of Allah. As for what follows:
I have looked into what was published in the third issue of the Journal of the Islamic Sciences Association in the section “News of Muslims in the Month.”
The Islamic Sciences Association in the Hashemite Kingdom of Jordan intends to erect a mosque on the cave recently discovered in the village of al-Rahib, which is the cave said to be where the People of the Cave, mentioned in the Noble Qur’an, slept. End of quote.
And out of the duty of advising Allah and His servants, I saw fit to direct a word in the same journal to the Islamic Sciences Association in the Hashemite Kingdom of Jordan, the content of which is advice to the Association regarding the execution of their intention to erect a mosque on the aforementioned cave. This is only because erecting mosques on the graves of the prophets, the righteous, and their sites is something from which the complete Islamic Shari’ah has prohibited and warned, and has cursed whoever does it; because it is one of the means of shirk (associating partners with Allah) and exaggeration regarding the prophets and the righteous. Reality is a witness to the truth of what the Shari’ah brought, and a proof that it is from Allah (Mighty and Majestic), and a clear proof and decisive argument for the truthfulness of the Messenger of Allah (peace and blessings be upon him) in what he brought from Allah and conveyed to the Ummah. And whoever reflects on the conditions of the Islamic world and what has occurred in it of shirk and exaggeration due to the erection of mosques on shrines, their veneration, carpeting, beautification, and the appointment of custodians for them, knows with certainty that they are among the means of shirk.
And among the excellences of the Islamic Shari’ah is the prohibition of this and the warning against erecting such mosques. And among what has been reported in this regard is what the two Shaykhs, al-Bukhari and Muslim (may Allah have mercy on them), narrated from Aisha (may Allah be pleased with her) who said: The Messenger of Allah (peace and blessings be upon him) said:
Allah cursed the Jews and the Christians that they took the graves of their prophets as mosquesلعن الله اليهود والنصارى اتخذوا قبور أنبيائهم مساجد

, Aisha said: He was warning against what they did. She said: And were it not for that, his grave would have been made prominent, except that he feared it would be taken as a mosque. And in the two Sahihs also:
That Umm Salama and Umm Habiba (may Allah be pleased with them both) mentioned to the Messenger of Allah (peace and blessings be upon him) a church they had seen in the land of Abyssinia and the images in it, so he (peace and blessings be upon him) said: Those people, when a righteous man dies among them, they build a mosque over his grave and depict those images in it. Those are the worst of creation in the sight of Allah.أن أم سلمة وأم حبيبة رضي الله عنهما ذكرتا لرسول الله ﷺ كنيسة رأتاها بأرض الحبشة وما فيها من الصور فقال ﷺ: أولئك إذا مات فيهم الرجل الصالح بنوا على قبره مسجدا وصوروا فيه تلك الصور أولئك شرار الخلق عند الله

And in Sahih Muslim from Jundub ibn Abdullah (may Allah be pleased with him) he said: I heard the Messenger of Allah (peace and blessings be upon him) five days before he died saying:
I stand acquitted before Allah that I took any one of you as friend, for Allah has taken me as His friend, as he took Ibrahim as His friend. Had I taken any one of my Ummah as a friend, I would have taken Abu Bakr as a friend. Beware of those who preceded you and used to take the graves of their prophets and righteous men as places of worship, but you must not take graves as mosques; I forbid you to do that.إني أبرأ إلى الله أن يكون لي منكم خليل فإن الله قد اتخذني خليلاً كما اتخذ إبراهيم خليلاً ولو كنت متخذًا من أمتي خليلًا لاتخذت أبا بكر خليلا ألا وإن من كان قبلكم كانوا يتخذون قبور أنبيائهم وصالحيهم مساجد ألا فلا تتخذوا القبور مساجد فإني أنهاكم عن ذلك

And the hadiths in this chapter are numerous, and the Imams from the scholars of the Muslims from all four schools of jurisprudence and others have explicitly stated the prohibition of taking graves as mosques and warned against it, acting in accordance with the Sunnah of the Messenger of Allah (peace and blessings be upon him), advising the Ummah and warning them from falling into what those before them fell into, namely the extremists among the Jews and Christians and their like from the misguidance of this Ummah.
So it is obligatory upon the Islamic Sciences Association in Jordan and other Muslims to take hold of the Sunnah, follow the path of the Imams, and beware of what Allah and His Messenger have warned against. In that lies the well-being of the servants, their happiness, and their salvation in this world and the Hereafter. And some people have relied in this chapter on His saying (Exalted is He) in the story of the People of the Cave:
Said those who prevailed in the matter, "We will surely take [for ourselves] over them a masjid."قَالَ الَّذِينَ غَلَبُوا عَلَى أَمْرِهِمْ لَنَتَّخِذَنَّ عَلَيْهِمْ مَسْجِدًا
[al-Kahf: 21]
And the answer to that is to say: Allah (Glorified and Exalted is He) informed about the leaders and those in control in that time that they said this statement, and that is not by way of approval and confirmation for them, but rather by way of blame, criticism, and detestation of their action. And what indicates this is that the Messenger of Allah (peace and blessings be upon him), upon whom this verse was revealed and who is the most knowledgeable of people regarding its interpretation, prohibited his Ummah from taking graves as mosques, and warned them against it, and cursed and blamed whoever did it. And if it had been permissible, the Messenger of Allah (peace and blessings be upon him) would not have been so severe in that great severity, nor would he have gone to the extent of cursing whoever did it, and informing that they are among the worst of creation in the sight of Allah (Mighty and Majestic). And this is sufficient and convincing for one who seeks the truth.
And even if we assume that taking graves as mosques was permissible for those before us, it is not permissible for us to imitate them in that; because our Shari’ah abrogates the Shari’ahs before it, and our Messenger (peace and blessings be upon him) is the Seal of the Messengers, and his Shari’ah is complete and general, and he has prohibited us from taking graves as mosques. So it is not permissible for us to contradict him, and it is obligatory upon us to follow him and hold fast to what he brought, and to leave what contradicts that from the old Shari’ahs and the customs considered good by those who practiced them; because there is nothing more complete than the legislation of Allah, and no guidance better than the guidance of the Messenger of Allah (peace and blessings be upon him).
And Allah is the One asked to grant us and all Muslims success in standing firm upon His religion and holding fast to the Shari’ah of His Messenger Muhammad (peace and blessings be upon him) in words and deeds, in the apparent and the hidden, and in all affairs, until we meet Allah (Mighty and Majestic). And He is the All-Hearing, the Near. And may Allah send blessings and peace upon His servant and Messenger Muhammad, his family and his Companions, and whoever follows his guidance until the Day of Judgment.
