Ruling on performing sa'y before tawaf
Machine translationRead the Arabic original
A question was received from our brother Isa Abdul Wahhab from Sudan, in which he says: I read in some books of rites: If one performs sa'y before tawaf out of ignorance or forgetfulness, there is nothing on him, citing the hadith: Is this correct? And what is the degree of authenticity of this hadith? Please inform us, may Allah reward you with good?
Answer: Yes, it is correct, and we have explained it in our book of rites (Al-Tahqiq wa al-Iyadh fi Kathir min Masail al-Hajj wa al-'Umrah wa al-Ziyarah). The hadith is in the authentic collections from the Prophet (peace and blessings be upon him) that a questioner asked him, and he said: and he did not order him to repeat the sa'y, which indicates that there is no blame in that, especially if he was ignorant or forgetful, so the matter is clearer in that case. And he said in the hadith: , and this is also covered by his statement (peace and blessings be upon him) in the authentic hadith when he was asked on the Day of Sacrifice: .
This generality covers the one who performs sa'y before tawaf, and that it suffices for him, just as it would suffice for him if he slaughtered before stoning the pillars or performed tawaf before stoning the pillars, even though the Prophet (peace and blessings be upon him) stoned the pillars, then slaughtered, then shaved, then performed tawaf, arranging it in this order: stoned the pillars, then slaughtered, then shaved, then performed tawaf. But this arrangement by the Prophet (peace and blessings be upon him) is not obligatory, but it is the best. So if one brings forward some of these acts before others, there is no blame, whether he did it intentionally, out of ignorance, or out of forgetfulness. This includes tawaf and sa'y as well. So if one performs sa'y before tawaf out of forgetfulness or ignorance, there is no blame without doubt. And likewise, if he did it intentionally, according to the correct opinion, due to the generality of his statement (peace and blessings be upon him) to the man when he asked him: and he did not ask him, saying: Are you forgetful? Are you ignorant? Rather, he stated it generally, and the general statement indicates generality. Yes.

I performed sa'y before tawaf. He said: Do it, and there is no blame.
سعيت قبل أن أطوف، قال: افعل ولا حرجAnswer: Yes, it is correct, and we have explained it in our book of rites (Al-Tahqiq wa al-Iyadh fi Kathir min Masail al-Hajj wa al-'Umrah wa al-Ziyarah). Did you perform sa'y before tawaf? He said: Perform tawaf, and there is no blame.
سعيت قبل أن أطوف؟ قال: طف ولا حرجEven if it was intentional.
ولو عامدًاHe said to him: O Messenger of Allah! I shaved before I slaughtered? He said: Slaughter, and there is no blame. And another said: I slaughtered before I stoned the pillars? He said: There is no blame. And another said: I left Mina before I stoned the pillars? He said: There is no blame. The narrator said: So he was not asked on that day about anything brought forward or delayed except that he said: Do it, and there is no blame.
I performed the Sa'y before I performed the Tawaf? He said: There is no harm.
