The first message in this episode is from listener Bashir Hasan Uthman from Sudan. Our brother Bashir says: There is one mosque in our village, and to its north and behind it are domes to which people make pilgrimages, they circumambulate them, and they call upon them for aid. What is the ruling on praying in this mosque, especially the Friday prayer, and this is the only mosque in the village? May Allah reward you with good.
Answer: In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, and may Allah send prayers and blessings upon the Messenger of Allah, and upon his family and his Companions, and upon those who follow his guidance.
As for the matter: If this mosque is as you described, there is no harm in praying in it. There is no blame on praying the Friday prayer or other prayers in it. The fact that there are graves to its north or behind it does not prevent this. However, it is obligatory upon the scholars and the righteous people of the village to disapprove of the people’s actions with the graves, such as associating partners with Allah, calling upon the people of the graves for aid, supplicating to them instead of Allah, and circumambulating them. All of this is among the great prohibitions, indeed, it is major shirk (associating partners with Allah). Asking the dead and calling upon the dead for aid is major shirk and is from the practice of the pre-Islamic age of ignorance (jahiliyyah), the practice of Abu Jahl and his like. Likewise, circumambulating the graves to draw near to them through circumambulation is major shirk. However, if one thinks that circumambulating the graves is worship of Allah and not drawing near to the grave, then it is a religious innovation (bid'ah), an abomination, and a means to shirk; because circumambulation is only for the Ancient House, the Ka'bah. So, if circumambulating the graves is intended to draw near to their people, it is major shirk. If the intention is to draw near to Allah, thinking it is a means of nearness here, then all of this is a religious innovation, an abomination, and invalid; because circumambulation is a specific characteristic of the Ancient House
perform Tawaf around the ancient House."وَلْيَطَّوَّفُوا بِالْبَيْتِ الْعَتِيقِ
[Al-Hajj: 29].

Then let them end their untidiness and fulfill their vows and perform Tawaf around the ancient House."ثُمَّ لْيَقْضُوا تَفَثَهُمْ وَلْيُوفُوا نُذُورَهُمْ وَلْيَطَّوَّفُوا بِالْبَيْتِ الْعَتِيقِ
[Al-Hajj: 29]. It is obligatory upon the scholars, wherever they are, to teach the people and guide them, especially in Sudan and other countries where there are graves that are worshipped instead of Allah. It is obligatory upon the scholars to teach them and disapprove of this great shirk. Likewise, mosques built over graves are not permissible; rather, they must be demolished and removed. Graves must be open to the sun, with no building over them, not graves or anything else. The Prophet (peace and blessings be upon him) said:
Allah cursed the Jews and the Christians that they took the graves of their prophets as mosquesلعن الله اليهود والنصارى اتخذوا قبور أنبيائهم مساجد

. When Umm Salama and Umm Habiba (may Allah be pleased with them both) informed him about the churches in Abyssinia and the images in them, he (peace and blessings be upon him) said:
If any righteous pious man dies amongst them, they would build a place of worship at his grave and make these pictures in it; they are the worst creatures in the sight of Allah.أولئك إذا مات فيهم الرجل الصالح بنوا على قبره مسجدًا وصوروا فيه تلك الصور أولئك شرار الخلق عند الله
Sahih al-Bukhari 434
. So he informed them that they are the worst of creation because they built over the graves and took images over them. This is from the means of worship, from the means of worshipping other than Allah and associating partners with Him. Therefore, he (peace and blessings be upon him) clarified that they are the worst of creation. It is authentic from Jabir (may Allah be pleased with him) from the Prophet (peace and blessings be upon him):
That he prohibited plastering the graves, sitting on them, and building on them.أنه نهى عن تجصيص القبور والقعود عليها والبناء عليها
, narrated by Muslim in the Sahih. So it is not permissible to build over the graves, whether mosques, domes, or anything else, nor to plaster them, nor to supplicate to them instead of Allah, nor to call upon their people for aid. Rather, one must beware of that. The visit is only the lawful visit to greet their people and supplicate for them with forgiveness and mercy. As for building over them or making mosques or domes over them, this is all an abomination and a means to shirk. And as for supplicating to them, calling upon their people for aid, and seeking help, this is major shirk. If one says: "O so-and-so, O my master so-and-so, help, help, aid, aid," this is major shirk, we seek refuge in Allah. This is done at some graves, such as the grave of al-Badawi and al-Husayn in Egypt, and Shaykh Abdul Qadir in Iraq, and other graves that the ignorant worship.
It is obligatory for the people of knowledge, wherever they are, to clarify this to the people and warn them against shirk (associating partners with Allah). Allah has taken a covenant and a pledge from the scholars that they should clarify things for the people, warn them, and teach them. It is obligatory for the common people to ask, to be discerning, and to gain understanding in the religion. They should not be deceived by the customs of their fathers and grandfathers. Allah (Glorified and Exalted is He) criticized the mushrikin (those who associate partners with Allah) when they argued by their fathers, where Allah said about them:
Indeed, we found our fathers upon a religion, and we are in their footsteps [rightly] guided."إِنَّا وَجَدْنَا آبَاءَنَا عَلَى أُمَّةٍ وَإِنَّا عَلَى آثَارِهِمْ مُقْتَدُونَ
[Surah al-Zukhruf: 23]. He criticized them for this state. So it is obligatory for the Muslim to be discerning in his religion and gain understanding in his religion; he should learn and be discerning, ask the people of knowledge, and not argue by the customs of the pre-Islamic age of ignorance or by the customs of the fathers and grandfathers that contradict the Shari'ah (Islamic sacred law) of Allah .
