السؤال:
One of the female listeners sent a message to the program. Her name is Husniyah Muhammad Ba Wazir from Hadramawt. She says: There is a person who is still studying and has no wealth from his work, but he receives some money from his relatives, and this money is sufficient to pay the expiation. Is he required to expiate his oath first, or should he use this money for his sustenance and that of his day? May Allah reward you with good?

Answer:
In the name of Allah, the Most Gracious, the Most Merciful. Praise be to Allah, and may Allah send prayers and blessings upon the Messenger of Allah, and upon his family and his Companions, and upon those who follow his guidance. As for what follows:
If the student mentioned has an oath upon him and he has nothing to support his condition except what he received from his relatives, which is the amount of his maintenance, then the expiation by money is not obligatory upon him. Rather, he expiates by fasting, which is fasting for three days, as the Lord, Exalted is He, specified in His great Book in Surat al-Ma'idah; where He said: :
Allah will not impose blame upon you for what is meaningless in your oaths, but He will impose blame upon you for [breaking] what you intended of oaths. So its expiation is the feeding of ten needy people from the average of that which you feed your [own] families or clothing them or the freeing of a slave. But whoever cannot find [or afford it] - then a fast of three days [is required]. That is the expiation for oaths when you have sworn. But guard your oathsلاَ يُؤَاخِذُكُمُ اللّهُ بِاللَّغْوِ فِي أَيْمَانِكُمْ وَلَكِن يُؤَاخِذُكُم بِمَا عَقَّدتُّمُ الأَيْمَانَ فَكَفَّارَتُهُ إِطْعَامُ عَشَرَةِ مَسَاكِينَ مِنْ أَوْسَطِ مَا تُطْعِمُونَ أَهْلِيكُمْ أَوْ كِسْوَتُهُمْ أَوْ تَحْرِيرُ رَقَبَةٍ فَمَن لَّمْ يَجِدْ فَصِيَامُ ثَلاَثَةِ أَيَّامٍ ذَلِكَ كَفَّارَةُ أَيْمَانِكُمْ إِذَا حَلَفْتُمْ وَاحْفَظُواْ أَيْمَانَكُمْ
[Surat al-Ma'idah: 89].
So He, , made it clear that whoever is unable to perform this expiation, which is feeding, clothing, and freeing a slave, and is unable to perform these three, should fast for three days. If the student has nothing except what satisfies his need and requirement for food, drink, and clothing, then he expiates by fasting, fasting for three days, and praise be to Allah.
