The Ruling on the Ma'mum Omitting the Recitation of al-Fatihah

Machine translationRead the Arabic original
Question:
The second question asks: If the ma'mum (one praying behind the imam) leaves out the second pillar of the pillars of prayer—and I mean the recitation of al-Fatihah—does his prayer become invalid? And what do we say about the saying of the Messenger of Allah (peace and blessings be upon him), the meaning of which is: that the prayer in which al-Fatihah is not recited is deficient, deficient, deficient, and in his saying (peace and blessings be upon him):
There is no Salat for the one who does not recite Fatihatil-Kitab.لا صلاة لمن لم يقرأ بفاتحة الكتاب
Jami` at-Tirmidhi 247Sahih (Darussalam)
?

Answer:
As for the imam and the one praying alone, their prayer becomes invalid if they do not recite al-Fatihah, based on the two hadiths mentioned.
As for the ma'mum, there is scholarly disagreement on this; if he intentionally leaves it out while knowing what has come in the Sunnah, and believing that its meaning has no contradiction, then his prayer becomes invalid according to the most correct opinion of the scholars.
However, if he leaves out its recitation because he exercised independent legal reasoning (ijtihad) and held that it is only for the one praying alone and the imam, or if he did so out of ignorance of the legal ruling, then his prayer is valid; because he did not intentionally do what Allah has forbidden, nor leave what Allah has made obligatory, but rather he left it out either through ijtihad or through ignorance of the legal ruling, so his prayer is valid.
As for the one who knows the legal ruling and believes that it is obligatory for him, but then intentionally leaves it out, his prayer becomes invalid; because he contradicted his belief and contradicted what he knows to be the truth. There is no doubt that its recitation is very important, and the scholars have differed on its obligation, and the stronger position is: that it is obligatory for the ma'mum; due to the generality of the hadiths in this matter, so he should not leave it out, but rather it is obligatory for him to recite it. However, if he left it out out of forgetfulness or ignorance, or if he did not catch the standing, but rather came and found the imam in bowing, then his prayer is valid, and the rak'ah suffices for him, and he is not required to make up the rak'ah in which he caught the imam in bowing. This is the correct position held by the majority of scholars.

The presenter: But does the loud prayer differ from the silent prayer?

The Shaykh: No, absolutely; whether it is a loud prayer or a silent prayer, the evidence for this is what al-Bukhari narrated in his Sahih from the hadith of Abu Bakrah al-Thaqafi, that he came to the Prophet (peace and blessings be upon him) while he was in bowing, so he bowed with him and did not recite al-Fatihah, but rather he missed the standing, so he bowed behind the row, then he walked to the row and entered it while the imam was in bowing.
The point is: that he came and found the imam in bowing, so he bowed behind the row, then he walked to the row and entered it, and the Prophet (peace and blessings be upon him) said to him:
May Allah increase your eagerness! But do not do it again.زادك الله حرصًا، ولا تعد
Sunan Abi Dawud 683Sahih (Al-Albani)
and he did not order him to make up the rak'ah, which indicates that whoever catches the imam in bowing, the rak'ah suffices for him, and the recitation of al-Fatihah is dropped from him; because he is excused by missing the standing, and likewise the one who is ignorant of the legal ruling, or who forgets al-Fatihah, and he is with the imam who bears it for him like the ignorant person, yes.
