Question:
In his first question, he says: I married my maternal aunt’s daughter, and I have two children from her. I have now learned that I was breastfed along with my maternal uncle, who is younger than her mother, until I reached the age of weaning. What should I do now regarding this wife of mine?
Please inform us, may Allah reward you.

Answer:
In the name of Allah, the Most Gracious, the Most Merciful.
Praise be to Allah, and may Allah send prayers and peace upon the Messenger of Allah, and upon his family and his Companions, and upon those who follow his guidance. As for what follows:
If the breastfeeding mentioned is established by the testimony of trustworthy women, or a trustworthy man, that you were breastfed along with your maternal uncle from your maternal uncle’s mother, or the mother of the woman you married, then you are also her maternal uncle; because you were breastfed by her grandmother, who is your maternal uncle’s mother and your wife’s mother. If the breastfeeding was complete, five times or more, then she becomes your sister’s daughter, and the marriage is invalid. We ask Allah to replace each of you with something better than the other.
As for the offspring, they are your offspring; because the intercourse was based on the belief in a valid Islamic marriage, and you are excused due to ignorance. So the children are your children and her children, and there is no blame on you regarding what has passed. As for the future, you must separate from her; because she has become your sister’s daughter at that point, and you are the brother of her mother. Yes.

The presenter: If we suppose and assume such a situation, and the husband died before he learned of this status, does the wife inherit from him?

The Shaykh: If he died and then it was revealed that he was in this position, he would not be a husband; the marriage is invalid, and there is no mutual inheritance between them.

The presenter: There is no mutual inheritance between them.

The Shaykh: No, there is no inheritance involved.
