Question:
This questioner, O esteemed Shaykh, sent a set of questions. He says: What is the ruling on the Duha prayer if it is prayed ten minutes before the midday prayer? Is it permissible? And what is the number of rak'ahs for the Duha prayer? And when does its time begin?

Answer:
The Sunnah is to pray it when the morning heat is intense, before the sun stands still, before the sun stands still. One should pray it when the morning heat is intense; this is the best. The time for it begins when the sun rises the height of a spear; its time has entered until the sun stands still. So one should not pray it and let the time of standing pass. The standing is about a quarter to a third of an hour before the zenith, when the sun is in the middle of the sky. So one should pray it when the morning heat is intense; this is the best. This is based on his saying (peace and blessings be upon him):
The prayer of those who are penitent is observed when your weaned camels feel the heat of the sun.صلاة الأوابين حين ترمض الفصال
Sahih Muslim 748a
This is the best. And it is a Sunnah; because the Messenger (peace and blessings be upon him) advised Abu al-Darda and Abu Hurayrah to do it ... and he (peace and blessings be upon him) used to perform it, so it is a Sunnah. Yes.
