Question:
He inquires about the noble verse, saying in the noble verse: [al-Baqarah: 226] What is the meaning of the word *ila'*?
Answer:
The verse: [al-Baqarah: 226] *Yu'ulun*: they swear oaths; *al-iliyah*: the oath. So if he says, "By Allah, I will not have intercourse with you," or "By Allah, I will not have sexual relations with you," he is given a period of four months. Then either he fulfills his oath and has intercourse with her, or he divorces her, if the woman demands it, based on the saying of Allah the Exalted: [Al-Baqarah 2:226] AND IF THEY ARE DETERMINED TO DIVORCE, THEN INDEED, ALLAH IS HEARING, AWARE [al-Baqarah: 226-227].
So if the wife demands, saying, "Either he fulfills his oath or he divorces me," the judge, the court, compels him, saying to him, "Either you fulfill your oath, reunite with your wife, treat her well, and have intercourse with her; or else, divorce her." But if the woman permits it, saying, "No, ... ... ...," there is no harm, even if it exceeds four months. However, if she demands, saying, "No, I want my right; either he fulfills his oath and has intercourse with me, treats me well, or he divorces me," then he is detained, prevented, and detained until either he divorces her or he fulfills his oath.
