What should one do if her husband does not pray and does not fulfill their rights?

Question:
We move on to a message received by the program from Nineveh, sent by one of the sisters from there. The questioner (L. A. J.), our sister, says: My first question is: I am a girl who married a man who does not fast, does not pray, and drinks intoxicants. I, too, did not pray or fast, but after a period of my marriage, Allah guided me to prayer and fasting, and praise be to Allah.
As for what follows: I want to explain my situation with my husband. I am living in his family’s house, which consists of four rooms. Each of his brothers, along with his wife, lives in one room, and they have no children. As for me, my room is a place for sitting, eating, and receiving visitors, and I have four children. Despite all this, my husband treats me harshly, does not spend on me, and does not give me anything. He insults me and insults my family. If I or my children fall ill, he refuses to give me any allowance; rather, he is the one who asks me for an allowance, even though I have no source of income.
Furthermore, he prevents me from seeing my family and brothers. As for me, I fulfill his duties and the duties of his mother in all circumstances. I also fulfill the duties of his married brothers and am responsible for the entire house. His mother also treats me and my children harshly and beats them—perhaps she means hitting—and I cannot do anything. Guide us on what to do? May Allah reward you with good. What do you advise this family regarding this treatment of me?

Answer:
Praise be to Allah who guided you to prayer and fasting and protected you from Satan. This is the greatest blessing and the greatest favor, and praise be to Allah for that.
As for the bad treatment you mentioned from the husband and the mother-in-law, you, O sister in Allah, must be patient, seek reward from Allah, and do good. One who does good does not regret it, and his outcome is good. However, if the husband does not pray, as you mentioned earlier, there is no good in him. It is not permissible to remain with him; rather, you should go to your family with your children. It is not permissible to remain with him as long as he is in this bad state: not praying, drinking intoxicants, and being bad in companionship. There is no reason to remain with him, and Allah will give you something better than him.
Therefore, you should distance yourself from him and go to your family. If Allah guides him after that, he can look into the matter. Otherwise, Allah will give you something better and better:
And whoever fears Allah - He will make for him a way outوَمَنْ يَتَّقِ اللَّهَ يَجْعَلْ لَهُ مَخْرَجًا ۝
[At-Talaq 65:2]
and He will provide for him from where he does not expect [Al-Talaq: 1-3], and He, the Exalted, says:
And whoever fears Allah - He will make for him of his matter ease.وَمَنْ يَتَّقِ اللَّهَ يَجْعَلْ لَهُ مِنْ أَمْرِهِ يُسْرًا
[Al-Talaq: 4].
If Allah guides him and he returns to the right path, repents to Allah, performs the prayer, leaves intoxicants, and improves his companionship, praise be to Allah. We ask Allah for his guidance. If he remains in his state, my advice to you is to distance yourself from him so that he does not harm you and your children, so that he does not drag you into his evil, and so that he does not drag his children into his evil as well, such as abandoning prayer, drinking intoxicants, and bad character. We ask Allah for safety and well-being.
The result and summary of this is: I advise you to go to your family with your children and leave him as long as he is in this bad state of abandoning prayer and consuming intoxicants. We ask Allah for guidance for us and for him, and we ask Allah to make things easy for you, relieve your distress, and give you a good outcome. May He reward you for the good you have done, return him to the right path, guide him to the right path, and guide his mother as well to the right path and good treatment. Indeed, He, Exalted and Majestic is He, is generous and noble.
