Ruling on breaking tree branches in the Haram

Machine translationRead the Arabic original
Question:
Following this, a message was received by the program from one of the listening brothers. He says: Your brother in Allah, Sulayman, is Egyptian and resides in al-Madinah al-Munawwarah. He says: I performed the obligatory Hajj, and praise be to Allah, Lord of the Worlds. However, while wearing the ihram, in Mina before the Day of 'Arafah, I was sitting under a planted tree. Due to the intense heat, I placed a parasol on it and broke one of its small branches, forgetting and ignoring that I was in a state of ihram; this was due to the severity of the heat. So, is there anything upon me? Even though I asked one of the brothers, and he told me: As long as the tree was planted by an individual and did not grow on its own, there is nothing upon you?
Please guide us, may Allah reward you with good.

Answer:
If a person in the state of ihram takes shade under a tree, an umbrella, a mountain, or a tent, there is no blame on him, praise be to Allah. The correct ruling is that nothing is required of you, whether the tree grew on its own or was planted by someone else, whether a person planted it or it grew by the action of Allah (Glorified and Exalted is He) without being planted.
So the result is: that the person in ihram taking shade from a tree, a tent, a parasol, or the like; there is no blame in this, yes.

The presenter: May Allah reward you with good. If he broke a branch from a planted tree, is he considered to have violated the sanctity of the Haram, Shaykh 'Abd al-'Aziz?

The Shaykh: Yes, if it is in the Haram, nothing is broken, and one does not transgress, not even thorns are cut, yes.

The presenter: And if it was planted, as was told to him?

The Shaykh: If it is planted, there is no harm in the planting of a human being, there is no harm.

The presenter: Praise be to Allah. So, in this situation, there is no expiation upon him?

The Shaykh: If it was planted by a human being, no, there is nothing upon him.

The presenter: May Allah reward you with good.
