Question:
From one of the female listeners, she says: Your sister in Islam (Dr. A. H.) from al-Arish, our sister has a case in which she says: A woman was married, then her husband died, leaving her two sons and no money. So she left the children with their family and married another man, and bore from him a son and a daughter. Then this man she married wrote a piece of agricultural land for her. Is it permissible for her to write this land in the names of her children from this man, since it is originally their father's land, or should she leave the land so that her children from the first man inherit it? May Allah reward you with good.

Answer:
It is obligatory for her to leave the land for everyone, so she has no right to give it specifically to her children from the new husband. The land is for everyone; she must be just among them. The Prophet (peace and blessings be upon him) said:
Be afraid of Allah, and be just to your children.اتقوا الله، واعدلوا بين أولادكم
Sahih al-Bukhari 2587
Even if the land were from the new husband, it would become her property, so she has no right to give it to one of them, nor does she have the right to bequeath it to one of them, but rather it is for everyone. It remains in her hand, in her ownership, and they inherit it from her, or she may divide it among them, and there is no harm in that. As for giving it specifically to one of them; no. Yes.
