Question:
One of my colleagues was involved in a car accident and sustained severe injuries, remaining unconscious for fifty-five days. After he regained consciousness, he asked the doctors to bring him earth so he could perform dry ablution with it to pray, but they did not do so. He left off prayer for three months, excluding the fifty days during which he was unconscious.
My question is: What is the ruling on his action? Does he have to make up the prayers missed during the unconsciousness and the period after it, or what should he do?

This is a mistake. It is obligatory for him to pray according to his condition, because Allah said:
So fear Allah as much as you are ableفَاتَّقُوا اللَّهَ مَا اسْتَطَعْتُمْ
[Surat al-Taghabun: 16]. The scholars have reached consensus that a believer prays according to his condition. If he finds neither water nor earth, and is unable to perform dry ablution or ablution, he prays according to his condition.
The Companions prayed during the time of the Prophet (peace and blessings be upon him) when he sent them to search for Aisha’s necklace without ablution or dry ablution, as they had no water, and dry ablution had not yet been prescribed. They prayed according to their condition, and the Prophet (peace and blessings be upon him) did not disapprove of them.
Therefore, it is obligatory for the sick person and others among the people to pray according to their condition. If he finds water, he prays with water. If he does not find water, he performs dry ablution. If he is prevented from performing dry ablution and what is needed for it is not available, he prays according to his condition, like a prisoner who is bound to a plank or the like, and cannot access water or earth; he prays according to his condition:

As for the days of unconsciousness, the scholars differed on them. If he makes them up, that is more cautious. If he does not make them up, there is nothing wrong with it, because it was a long period, and unconsciousness resembles insanity, so there is no obligation to make them up, if Allah wills. If he makes them up, there is no blame on him. However, if the unconsciousness was brief, such as two or three days, he must make them up. Some of the Companions became unconscious and made up the short period. But if it exceeds three days and becomes prolonged, the stronger view is that there is no obligation to make them up, because in that case it resembles the state of an insane person or one of unsound mind. As for unconsciousness for two or three days, this resembles the state of a sleeper, so he must make them up.
