Ruling on disposing of orphans' wealth and mixing it with other property

Machine translationRead the Arabic original
Question:
The questioner: I inform you that I have younger brothers, and my mother and father have passed away (may Allah have mercy on them). My father left them wealth after his death, such as sheep, camels, and other things, as well as social security benefits and lands, and so on. I am the eldest of them, and I support them and spend on them. I am a military officer, and I receive salaries with which I support them. Is it permissible for me to mix my personal rights with their rights and dispose of them? Please inform us. May Allah reward you with good.

Answer:
The Shaykh: Yes, you may spend on them from their wealth according to their need, mixing it with your wealth. Whatever exceeds that, you should place it in something that benefits them. You gather it and buy with it a building, a shop, or agricultural land that benefits them. If the wealth is substantial, it can be used to buy a building, a plot of land, a shop, or a farm that benefits them. Or you can give it to a trustworthy person to trade with it and increase it through trade, and you take from him the amount of their expenses, adding it to what you have and spending on them. If you are in need, you may take an extra amount according to your need, along with their expenses, as Allah (Glorified and Exalted is He) said regarding the guardian of the orphan:
and whoever is poor - let him take according to what is acceptableوَمَنْ كَانَ فَقِيرًا فَلْيَأْكُلْ بِالْمَعْرُوفِ
[Surat al-Nisa: 6]. Whatever exceeds the need, as mentioned before, you buy with it for them a plot of land, a building, or agricultural land that they can benefit from, which benefits them and remains for them. Or you give it to someone from the people of goodness, trust, and honesty to trade with it until it grows.
