Ruling on a guardian taking from the property of orphans in his care

Machine translationRead the Arabic original
Question:
The questioner (Dr. Al-Harbi) from Suwaidrah says: I have orphans, and they are my brother’s sons, and I am the one who serves them and provides for them what they need, and they receive the state allowance. Is it permissible for me to eat from this money that the state pays them, or is it not permissible for me to do so? May Allah reward you with good.

Answer:
There is no blame on you for eating in a customary manner; because Allah (Exalted and Majestic is He) has made it permissible, He said (Exalted and Majestic is He):
And whoever, [when acting as guardian], is self-sufficient should refrain [from taking a fee]; and whoever is poor - let him take according to what is acceptable.وَمَنْ كَانَ غَنِيًّا فَلْيَسْتَعْفِفْ وَمَنْ كَانَ فَقِيرًا فَلْيَأْكُلْ بِالْمَعْرُوفِ
[Al-Nisa: 6]. So if you are in need, eat with them, and if you are wealthy, eat from your own money, and guard their money, and spend on them from it. And as for if you are in need, eat with them, and praise be to Allah, yes.

The presenter: May Allah reward you with good, and may He do you good.
