It is not permissible to give charity from the property of orphans

The second question of Fatwa No. ( 18937 )
Q2: I am a woman whose husband passed away a month ago, leaving me a son and six daughters. He has two parents, and he left us nothing but a small shop and the house in which we live.
So I asked his parents to forgive us regarding the inheritance, so that I might be able to raise these daughters. Am I sinful for this, even though they have forgiven me? And am I sinful if I give charity from the money, since it is the money of orphans and belongs to me, my son, and my daughters, and I am conducting trade in this shop inside the house?
A2: First: If your husband's parents forgive you of their share of the inheritance, that is their right, and there is no sin on you for that. Second: It is not permissible to give charity with the money of orphans, because your guardianship over them does not justify that for you. However, as for your own share, it is permissible for you to give charity from it according to the Shari'ah. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
