Question:
The people of the Islamic Maghreb suffer from the problem of entering the state of ihram from the miqat designated for them, as they pass over it while in the air, where they are unable to enter the state of ihram on the airplane or in the airports. Some of them have issued a fatwa for them to enter the state of ihram in Jeddah. What is your opinion of this fatwa?

Answer:
We have written a response to it, and we wrote to our brother whom Shaykh Abdullah Qanu issued a fatwa for: This is a mistake, and there is no hardship in entering the state of ihram on the airplane. Entering the state of ihram is saying: Labbaik 'umrah, Labbaik hajj. There is no hardship in the words: O Allah, Labbaik hajj, or: O Allah, Labbaik 'umrah. This is not a hardship for anyone. When one reaches the miqat or approaches the miqat and fears that he will pass it before reaching it, he fears: he should say the talbiyah, even before it, to be cautious regarding his ihram.
As for the ghusl and applying perfume, they are not obligatory. If he applies perfume on the airplane before entering the state of ihram, it is easy for him. He can put the perfume beside him, or with him, or in his bag, and apply it before entering the state of ihram. The ghusl is not obligatory, and he is able to take a ghusl in his house before entering the state of ihram. He takes a ghusl in his house before boarding the airplane. Even if he stays on the airplane for a day or half a day, he takes a ghusl in his house. The ghusl is a recommended practice, it is not obligatory.
Likewise, the clothing of ihram is worn in his house. He wears it on the airplane before entering the miqat, while he is in a state of ease. He wears the izar and the rida. It is easier for him to wear the izar in his house. He prepares it in his house and wears clothes over the izar. When he reaches the level of the miqat, he removes the clothes and wears the rida entirely. It is made easy for us to do this. A person does in his house what is easy for him: he applies perfume, takes a ghusl, and wears the izar and his clothes over the izar. When he approaches the miqat, he removes the clothes, wears the rida, and says the talbiyah. There is no hardship in this, and it is not permissible to pass the miqat ever, and the fatwa is a mistake.
