Question:
From the Al-Bahah region, Civil Defense in Al-Mandiq. This is a message sent by our brother Abdullah 'Atiyyah Abdullah. Our brother asks and says: A sum of forty silver riyals and a sum of seven hundred and seventy paper riyals were placed in trust with my father. He needed them due to the circumstances of life at that time. Their owners requested them, but they were not with my father when they requested them. Although my father was determined to return the amount, their owners have passed away approximately fifteen years ago.
I ask for guidance, may Allah reward you with good. Knowing that my father passed away seven months ago, and the amount is still his liability, please guide me on how to act?
May Allah reward you with good.
Answer:
It is obligatory for you to hasten to settle the amount to its owners from your father's estate, if he has an estate from which this amount can be paid. So you must deliver the amounts to their owners, and if they have died, then to the heirs. The money is paid to the heirs, the silver and the paper all together. The silver is silver, and the paper is paper. So you must deliver the silver to its owners, and the paper to its owners, unless they are lenient and accept paper in place of the silver, one riyal for every riyal. That is up to them. Otherwise, it is obligatory for you to pay them the silver they left with your father in trust, or its value in goods, gold, silver, paper, or the like. You give them its value or the item itself. You must deliver the silver itself or its equivalent value at the current price at the time of delivery to its owners, or to the heirs themselves.
And you must supplicate for your father for mercy and forgiveness, for he did wrong in his handling of it, and in delaying its owners. He did a great wrong in this. So we ask Allah to forgive him. And you must strive to deliver this right to its owners and seek their pardon so that they may supplicate for your father and forgive him. And Allah is the Helper. Yes.
The presenter: And Allah is the Helper, may Allah reward you with good.
