Answer: Touching the Mushaf without wudu is not permissible. This is the position of the majority of scholars and the majority of Muslims, and it is the view of the four Imams (may Allah have mercy on them). It is also what the Companions of the Prophet (peace and blessings be upon him) used to issue rulings on. It is established from him (peace and blessings be upon him) that he said in his letter to 'Amr ibn Hazm when he sent him to Yemen:Muwatta Malik 15:1 This indicates that the Qur'an is not to be touched by one who is in a state of major ritual impurity or minor ritual impurity, but only by one who is in a state of wudu and ritual purity. This is the relied-upon position. As for recitation, there is no harm in reciting from memory while in a state of minor ritual impurity. However, touching the Mushaf is not allowed. As for one in a state of major ritual impurity, he does not recite, neither from memory nor from the Mushaf, until he performs the full ritual bath. This is based on his statement (peace and blessings be upon him): Musnad Ahmad 872Hasan (Darussalam), and what came in the hadith of 'Ali (may Allah be pleased with him) where he said: It was narrated by the people of the Sunan and Imam Ahmad with a good chain of narration.

As for the hadith:, it is a weak hadith. Al-Tirmidhi (may Allah have mercy on him) and a group of others narrated it from the hadith of Isma'il ibn 'Iyadh from Musa ibn 'Uqbah. Isma'il (may Allah have mercy on him) is weak in his narrations from the people of the Hijaz, so this narration is not to be used as evidence. The preserved ruling is specifically regarding the one in a state of major ritual impurity, whose duration is short; as soon as he finishes, he performs the full ritual bath and recites, and praise be to Allah.
