The question: Our sister asks: Is it permissible for one who has broken the minor ablution to touch the Book of Allah to read it, provided the hand is covered?
The answer: It is obligatory to perform wudu' to read the Qur'an from the mushaf. As for reading it from memory without the mushaf, there is no harm, except for the one in a state of janabah. The one in a state of janabah does not read until he performs ghusl. However, the one who is not in a state of janabah, but rather has a state of minor ritual impurity, is required to perform wudu' to read from the mushaf. He may read from memory without touching the mushaf. This is based on the hadith from him (peace and blessings be upon him) that he said when he wrote a letter to the people of Yemen:
no-one should touch the Qur'an unless he was pureلا يمس القرآن إلا طاهر
Muwatta Malik 15:1
and the generality of His saying, the Exalted:
None touch it except the purified.لا يَمَسُّهُ إِلَّاا الْمُطَهَّرُونَ ۝
[Al-Waqi'ah 56:79]
a revelation from the Lord of the worlds [Al-Waqi'ah: 79-80].
This is the obligatory position, and it is the position of the majority of the scholars, including the four imams and others, that one does not touch the Qur'an except in a state of purity.
