This is a message from the sender (M. Q. L.) from Jizan. We had presented one of his questions in the previous episode, and now we are presenting the rest of his questions, which he requested be directed to your eminence. In his second question, he says: A man was involved in a car accident and lost his mental faculties. He sat for two days without knowing anything, without knowing the obligatory prayers, and without knowing how many obligatory prayers he missed? Should he make them up? Please advise us, may Allah reward you.
Answer: Yes, the one who is struck by an accident and remains for a day, two days, or three days without awareness, if he regains consciousness and becomes alert, he must make up the days on which he left off the prayer; because this is similar to sleep and similar to the fainting that happens to some people. So he prays those obligatory prayers that he missed and was not aware of. As for if the matter is prolonged, such that the period is long, more than three days, then there is disagreement among the scholars. Some said: he makes it up like the sleeper. And some said: he does not make it up due to the length of the period, and he is lacking in intellect, so he is more similar to the insane and the mentally deranged. And the closest view, and Allah knows best, is that what exceeds three days has no making up; because it is more similar to the insane and more similar to the mentally deranged. As for the three days, or what is less than that, this is more similar to the sleeper, so he makes it up. And the Prophet (peace and blessings be upon him) said:
Whoever sleeps through the prayer or forgets it, let him pray it when he remembers it. There is no expiation for it except that.من نام عن الصلاة أو نسيها فليصلها إذا ذكرها لا كفارة لها إلا ذلك
.
So fainting for a day, two days, and three days, this approximates sleep and resembles sleep, so he makes it up. As for what exceeds that, like the one who is unconscious for a month, two months, or more than that, then there is no making up upon him, if Allah wills, and he is more similar to the mentally deranged. Yes.
