Question:
The first message in this episode is from a listener: (A. B.) from Yemen. Our brother has a number of questions, one of which says: My son was involved in an accident that caused him to lose consciousness for three years, and he is still in that state now. What is the ruling on fasting for him? Is it dropped, or is expiation obligatory? Especially since he is not accountable, due to his loss of consciousness.
May Allah reward you with good.

Answer:
In the name of Allah, the Most Gracious, the Most Merciful.
Praise be to Allah, and may peace and blessings be upon the Messenger of Allah, and upon his family and his Companions, and whoever follows his guidance. As for what follows:
Your son owes nothing; because he has lost accountability due to the loss of intellect. It is authentic from the Messenger of Allah (peace and blessings be upon him) that he said:
The pen is lifted from three: the sleeper until he wakes up, the insane person until he regains his senses, and the minor until he reaches pubertyرفع القلم عن ثلاثة: عن النائم حتى يستيقظ، والمجنون حتى يفيق، والصغير حتى يبلغ
This is of the same kind as the insane person. The one who has lost his intellect has the same ruling as the insane person, even if he is not afflicted with insanity. The loss of intellect has the same ruling as the ruling for the minor who has not reached puberty.
The point is: Your son owes nothing. If Allah heals him, he does not have to make up any fasts. Likewise, everyone who is afflicted with such a trial does not have to make up any fasts; because he is in the category of the insane whose accountability has been lifted. We ask Allah for health, safety, and healing for us and for them. Yes.

The Shaykh: He does not have to pay expiation. Yes, no feeding, no fasting, and no making up of fasts. Yes.
