The third question in the letter of our brother Abbas Jadah al-Junabi. He says: I intend to go to the House of Allah the Exalted to perform the obligatory Hajj, if Allah wills, for the second time. Can I appoint one of the Muslims to perform the obligation on behalf of my deceased father in the same year? Please advise us, may Allah reward you.
Answer: There is no harm in that. You may have someone from the Muslims in Mecca perform Hajj on behalf of your father. There is no harm in giving money to someone you consider trustworthy, of good religion, and reliable in his work, so that he performs Hajj on behalf of your father. However, he must enter the state of ihram from the Halam, not from Mecca itself, for 'Umrah. As for Hajj, it is permissible for him to enter the state of ihram from Mecca itself, and there is no need for him to go to the miqat according to the more correct of the two opinions of the scholars. He enters the state of ihram from Mecca for Hajj. As for 'Umrah, he enters the state of ihram from the Halam, from al-Ja'ranah, or from at-Tan'īm, or from other places in the Halam, meaning outside Mecca, outside the sacred precinct. This is specifically for 'Umrah. As for Hajj, he enters the state of ihram from Mecca, from the Halam or the Haram, for your father, provided he is trustworthy and of good character. And success is from Allah. Yes.
