Ruling on Taking a Lost Camel
Machine translationRead the Arabic original
A listener (M. T. F.) sent a message asking and saying: Some of my father’s camels were lost, and he went to search for them. When he found them, he found a camel with them that he did not recognize and did not know its owner. He brought it back with his camels, and this camel stayed with us for a long time, and no one came to ask about it. My father (may Allah have mercy on him) passed away in 1984, and after that, the camel died. The question is: Does my father owe anything? And what must I do now, since I want to clear my father’s conscience? And what is the value I must pay, if it is obligatory, knowing that about twenty years have passed since this happened? May Allah reward you with good.
Answer: It is obligatory for your father to drive away this camel and not shelter it; because of the saying of the Prophet (peace and blessings be upon him) when he was asked about a lost camel:Sahih Muslim 1722e. So it was obligatory for him, when he found this camel with his camels, to drive it away and not shelter it. But since he sheltered it with his camels until the camel died, I do not know of anything upon you in that, if you did not cause its death, whether by tying it or loading it or otherwise. It was just with the camels, grazing with them, and then it died without any action from you, without any injustice from you, and without anything else. So I do not know of anything upon you in that. Yes.
The presenter: And to clear the conscience of the deceased, there is nothing in his conscience?
The Shaykh: ... There is nothing in his conscience except supplicating for him with forgiveness and mercy; because he erred in sheltering it, but he did not do anything to destroy it.
The presenter: May Allah reward you with good.

Leave that alone, for it has feet and also a leather bag, it drinks water, and eats (the leaves) of the trees
