The Ruling on Swearing by the Prophets, the Fathers, Honor, and the Qur'an
Machine translationRead the Arabic original
The second question in the letter of the brother (M. J.) from Raqqa, Syria, states: Many of our people swear by other than Allah. Is this permissible? For example, they say: "By the life of the Prophet Muhammad (peace and blessings be upon him)," or "By the life of 'Isa or Musa (peace be upon them both)," or "By the life of the Qur'an," or "By the life of my father's grave," or "I swear by my honor." Please inform us about this. May Allah reward you with the best reward.
Answer: Swearing by other than Allah is not permissible; rather, it is obligatory that one swear by Allah alone, (Glorified and Exalted is He); because it is established from the Messenger of Allah (peace and blessings be upon him) that he said:Riyad as-Salihin 1707, and he (peace and blessings be upon him) said: Sunan Abi Dawud 3251Sahih (Al-Albani), and in another wording: , and in another wording: Jami` at-Tirmidhi 1535Sahih (Darussalam). So, swearing by other than Allah is among the major prohibitions of disbelief, but it is minor shirk; except if one intends that the one by whom he swears is great like the greatness of Allah, or that he acts in the universe, or that he is worthy of being called upon besides Allah, then it becomes disbelief, we seek refuge in Allah. So, if he says: "By the life of so-and-so," or "By the life of the Messenger," or "By the life of 'Isa," or "By the life of Musa," or "My honor," or "My father's grave," or anything similar to that, all of it is swearing by other than Allah, and all of it is not permissible. Or swearing by trust, or by the Ka'bah, all of that is blameworthy. It is obligatory that one does not swear except by Allah alone, (Glorified and Exalted is He), or by one of His attributes, or by one of His names, (Mighty and Majestic). The Qur'an is from the speech of Allah; the Qur'an is from the attributes of Allah. So, if he says: "By the Qur'an," or "By the life of the Qur'an," there is no harm, because the Qur'an is the speech of Allah, (Glorified and Exalted is He). So, if he swears by the Qur'an, or says: "By the might of Allah," or "By the knowledge of Allah," or "By the life of Allah," there is no harm. The attributes of Allah are sworn by. But the created beings—no, one does not swear by a created being. Not by the Prophet (peace and blessings be upon him), who is the noblest of creation, nor by the Ka'bah, nor by trust, nor by the life of so-and-so, nor by the honor of so-and-so, nor by anything else; because the Messenger (peace and blessings be upon him) prohibited this and warned against it. And Ibn 'Abd al-Barr, the famous imam (may Allah have mercy on him), said: "The scholars agreed that it is not permissible to swear by other than Allah."
So, it is obligatory for the believer to beware of these false oaths, and to warn his brothers of that, and to call them to swear by Allah alone . Yes.
