Question:
We have received more than one question from a brother who complains about the increase in rents imposed on them, relying on the ruling that was issued. They said: This is an injustice that has befallen them, and others may not be ready to vacate the premises due to the large amount of merchandise they have. So what is the solution in that?
Answer:
The oppressor is the one who takes people's money without right. It is not the oppressor who makes... The oppressor is the one who wants the state to force the owner to give up his money without right. That is the oppressor. As for the release of real estate, it is among the good deeds of the state, and we ask Allah to keep it firm, and after that, affairs will be set right.
Fourteen centuries have passed in which people were not forced to lease out their properties; everyone leases as Allah commanded and as Allah permitted . As for the one who has a dispute or a problem regarding his house or his shop, because he introduced new things in it, the court rules between him and his partner.
The Messenger (peace and blessings be upon him) said:Sahih Muslim 1679b And he said: Sunan Ibn Majah 3933Sahih (Darussalam) And He, the Exalted, says in His great Book: [Al-Nisa: 29].
So it is false for the tenant to say: Go away, so-and-so, you have no right with me, and to drive him out of his house and his shop, because the state told him: Take it for such and such. This is the injustice, and this is the wrong. But when people become accustomed to falsehood, and when they become accustomed to corruption, and when they become accustomed to encroaching on people, they consider it permissible, and the right becomes injustice in their eyes, and injustice becomes lawful. It is like those who drink intoxicants and become accustomed to them; they do not accept that anyone prevents them from intoxicants. And those who are accustomed to smoking do not accept that anyone prevents them from smoking, because they are accustomed to it, and it has become a habit for them. They do not accept being prevented from it. We ask Allah for safety.
