Question:
A woman has a small daughter, and when the month of Ramadan approached, she wanted to wean her from breastfeeding. The girl kept crying for several nights, and then she died. At that time, the artificial milk now known for weaning children was not available. What is required of this mother? Does she have to fast, or what do you see as her obligation? May Allah guide you.

Answer:
It is obligatory for the mother to breastfeed her child to meet his needs, whether the child is male or female, in Ramadan or otherwise. This is her obligation. If fasting is difficult for her, she breaks her fast for the sake of the child. If it is difficult for the child, she must break her fast so that she can breastfeed the child. Once the child is weaned, or the child is weaned by other milk, she fasts thereafter.
As for this woman whose child died, if his death was due to her actions, such that she starved him until he died from hunger, then she is liable for his compensation through blood money and expiation. However, if he died for other reasons, not because of breastfeeding, then she owes nothing. His case is examined; if it is found that the child died due to her actions, and that she starved him severely until he died from hunger or thirst, meaning she did not breastfeed him until he died, then she owes blood money, unless the heirs forgive her. She also owes an expiation by freeing a male or female slave. If she cannot do so, she fasts for two consecutive months.
