Question:
What is the ruling on one who knows Allah's ruling on a specific aspect of Islam, but commits what is forbidden in it, and rejects Allah's ruling?

The Shaykh:
His ruling is the ruling of the people of sins. People know that unlawful sexual intercourse is forbidden, yet they commit it; they know that intoxicants are forbidden, yet they fall into them. So, upon the one who commits a sin while knowing it is a sin, its punishment is due, and its danger is upon him. But if he deems it permissible—if he says, "Unlawful sexual intercourse is lawful"—he becomes a disbeliever, may Allah protect us. If he says, "Intoxicants are lawful," he becomes a disbeliever. If he says, "Sodomy is lawful," he becomes a disbeliever, may Allah protect us. If he says, "Theft is lawful," he becomes a disbeliever.
As for one who commits these sins while knowing he is a sinner, knowing he is opposing Allah's command, and knowing he is in danger, he has the ruling of the sinners, under the will of Allah (Exalted and Majestic is He) . The Muslim state must establish Allah's command among them and apply Allah's fixed punishment. He does not become a disbeliever by that. If he commits unlawful sexual intercourse, he does not become a disbeliever unless he deems it permissible. If he drinks intoxicants, he does not become a disbeliever unless he deems them permissible and says they are lawful.
Likewise, if he is undutiful to his parents, he does not become a disbeliever. But if he says, "It is permissible for me to be undutiful to my parents," he becomes a disbeliever, may Allah protect us. And if he says, "It is permissible for me to commit unlawful sexual intercourse and drink intoxicants," he becomes a disbeliever, may Allah protect us.

In conclusion: The sinners are of two types:
Sinners who deem the sins Allah has forbidden to be permissible and view them as lawful. These are disbelievers who advocate permissibility, alongside the disbelievers. It is obligatory that they be called to repent, and if they do not repent, the rulers of the Muslims must execute them.

The second category: Sinners who know they are sinners and are aware of their sinfulness, but Satan and the soul inclined to evil lead them to commit the sin. These are as Allah (Exalted and Majestic is He) said, under His will:
And He forgives what is less than that for whom He wills.وَيَغْفِرُ مَا دُونَ ذَلِكَ لِمَنْ يَشَاءُ
[Surat al-Nisa: 48]. He is under the will of Allah. If Allah wills, He will forgive him if he dies in that state. If He wills, He will punish him according to the crime he died upon. Then, after he is purified in the Fire and punished, he will enter Paradise by the Islam he died upon and the oneness of Allah he died upon.
