Ruling on a guarantor renting out his guaranteed worker to another party for a monthly fee

Machine translationRead the Arabic original
Question:
Is it permissible for a guarantor to allow a worker in his employ to work for his own account according to his request, in exchange for giving the guarantor a specific monthly amount?

Answer:
No, that is not acceptable. This is not acceptable. The obligatory course, if there is no alternative, is for him to pay for the worker's cost first, and then utilize him afterward in whatever he wishes, under the conditions agreed between them, such as a certain amount each month. He should employ him in the type of work for which he was brought in, or in any work that the worker approves of and the hiring party approves of, provided it is any work that is permissible by the Shari'ah, in accordance with the method organized and clarified by the state for those who bring in workers.
