Is blood (sacrifice) obligatory for one who leaves after nightfall catches him in Mina and the sun sets on him on the twelfth day, which is the third day of the festival?

Machine translationRead the Arabic original
The questioner: I mean, do you see, O Shaykh, that blood (sacrifice) is obligatory for the one who leaves?

The Shaykh: No, that is a different matter, but I see that he should stay overnight there and continue to delay.

The questioner: But if he leaves, O Shaykh, if he leaves after Fajr on the thirteenth day intending to travel to his country and did not stone the pillars, what do we tell him?

The Shaykh: That is a different matter, my brother, may Allah reward you. I mean, you are also moving from one issue to another. Have you finished with the first one?

The questioner: O Shaykh, the second is dependent on the first, it is essential.

The Shaykh: No, it is not dependent, because it may be independent, and it may be a matter of independent legal reasoning. So not every mistake a pilgrim commits requires a ransom payment, do you not agree with me on this?

The questioner : Yes, yes, yes.

The Shaykh: So there is no connection between the two matters.

The questioner: So, O Shaykh, do we say that it is better for the one whom nightfall catches to stay overnight?

The Shaykh: We do not say that, rather it is obligatory, but...

The questioner: It is obligatory.

The Shaykh: But there is no text that obligates the ransom payment if he violates this, perhaps you understand me now?

The questioner : Yes, yes.

The Shaykh : May Allah reward you with good.

The questioner: May Allah honor you, my Shaykh.

The Shaykh : And may Allah protect you, if Allah wills.

The questioner : Peace be upon you, and Allah’s mercy and blessings.

The Shaykh : And upon you be peace, and the mercy of Allah and His blessings and His forgiveness.
