The questioner : If you please, Shaykh, I have a brother who works here at a company. The owner of the money is trusted with the sales. The owner of the money traveled to Germany, but his son is present and takes from him what he sells. One day, he found one hundred dinars in his brother's pocket, and they were a trust with him, so he took them, thinking they belonged to the shop.

The Shaykh : Who took them?

The questioner : The son of the employer, to whom he reports the revenue every day, took them. He thought the money belonged to the shop. The brother had a trust with him. He is certain that the employer's son is the one who took them, but he did not see it with his own eyes. However, he is certain that no one else was in the shop. So he asks: Is it permissible for him to take them again from the shop?

The Shaykh : Who takes them?

The questioner : Does the worker take them again from the shop without the shop owner?

The Shaykh : The question is not clear to me. Did the shop owner's son take the hundred dinars?

The questioner : From the worker's pocket.

The Shaykh : From the worker's pocket.

The questioner : Yes.

The Shaykh : Theft.

The questioner : In his belief that it was his money.

The Shaykh : Theft.

The questioner : Yes.

The Shaykh : Say yes or no?

The questioner : Yes.

The Shaykh: All right.

The questioner : Without him, and he was not present; he was praying Maghrib.

The Shaykh : Okay, did the boy's father come later?

The questioner : No, he is in Germany...

The Shaykh: He is present.

The questioner: Yes.

The Shaykh : And is this worker trusted with the shop's money?

The questioner : He is trusted.

The Shaykh : He is trusted, and there is no correspondence between him and the shop owner?

The questioner : No, he is afraid that if he calls the shop owner, the owner will think ill of him and believe his son.

The Shaykh : What?

The questioner : He is afraid that if he calls the shop owner, the owner will think ill of him and believe his son.

The Shaykh : What does he do to his son?

The questioner : Meaning, he believes his son and lies to the worker.

The Shaykh : This is not permissible. It is not permissible for him to take it without the knowledge of the shop owner or the owner of the money for whom he is the trustee. This is because of the authentic hadith in which he (peace and blessings be upon him) said:
Fulfill the trust for the one who entrusted you, and do not cheat the one who cheated you. أدِّ الأمانةَ إلى مَن ائتمنك ، ولا تَخُنْ مَن خانك
Jami` at-Tirmidhi 1264Da'if (Darussalam)
This is from one side, and from another side,
and no bearer of burdens will bear the burden of another وَلَا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى
[Al-An'am 6:164]
.

The questioner : Is he the son of the shop owner?

The Shaykh : I did not understand...

The questioner : I understood.

The Shaykh : I will answer you. And the last thing I told you:
and no bearer of burdens will bear the burden of another وَلَا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى
[Al-An'am 6:164]
. If the son steals, the father does not bear the burden of his son's sin, as mentioned in the hadith of Abu Ramthah: "His son was with him, holding his hand. He (peace and blessings be upon him) said:
Who is this? من هذا ؟
. He said: This is my son. He said:
You cannot be affected by his sin or he by yours. أما إنَّك لا تجني عليه ولا يجني عليك
Sunan an-Nasa'i 4832Sahih (Darussalam)
.

The questioner : Yes.

The Shaykh : So the son does not bear the burden of the father, and the father does not bear the burden of the son, if he did not do an act that is not related to the son.

The questioner : But the son performs his father's works... and takes the lands and obtains everything.

The Shaykh: Peace be upon you.
The student : Enough, let the Shaykh finish. Enough, my brother.
Another student: As long as you are standing, we want to stand, hehe.
