What is the ruling on a person who has money in one of the interest-based banks and finds that he has profit from this money, so he wants to give it in charity or give it to a student of knowledge?

Machine translationRead the Arabic original
The Shaykh : Yes, yes, Oman, there is no god but Allah. Yes, and peace be upon you. Yes, may Allah keep you and welcome you. I thank Allah for you. May it be a good one, if Allah wills. Welcome, Abu 'Abdullah, from Algeria. Yes.

The questioner : I have a question.

The Shaykh: And that is...

The questioner : There is a brother who had money in the interest-based banks, O Shaykh.

The Shaykh : Finish, finish your statement.

The questioner : I said, a brother had money in the interest-based banks.

The Shaykh : Yes, yes.

The questioner : And when he committed himself to the law of Allah, he found that he had money, meaning profit from this money. So here, this brother wanted to give it in charity or give it to one of the students of knowledge to go with it to seek knowledge. Is it permissible for him or not?

The Shaykh : I wish he had not committed this sin and had not given it in charity.

The questioner: May Allah reward you with good, O Shaykh.

The Shaykh : And beware of that.

The questioner : Meaning it is not permissible, O Shaykh.

The Shaykh : It is not permissible for a student of knowledge to take forbidden money to obtain the obligatory knowledge.

The questioner : Yes, yes, and not for charity, O Shaykh.

The Shaykh : Nor...

The questioner : And not for charity.

The Shaykh : Nor...

The questioner : I asked some of the brothers here, O Shaykh.

The Shaykh : Rather, this money is to be spent in public utilities, if there is no other option.

The questioner : O Shaykh.

The Shaykh: Yes.

The questioner : I had askedThe Shaykh : Ali Hasan, and he had told me that it is to be spent in public utilities as well. But a problem arose for me from some of the brothers, and they said to me, where does he get this evidence, meaning the evidence for public utilities.

The Shaykh : Do you want the evidence?

The questioner : Yes, the evidence, O Shaykh.

The Shaykh : My brother, this evidence is not explicitly stated in a way that every Muslim understands it, nor in a way that every student of knowledge understands it. Rather, this revolves around some of the principles of jurisprudence. Because this person who got involved and deposited his money in the bank, then repented and turned back, and withdrew the principal of his money, and they presented to him its interest, which they call profit, he is between two things: either he leaves the interest for the bank, and this enriches the bank with forbidden money, or he spends it in public utilities, and this spending is the lesser of two harms. So from the perspective of taking the lesser of two harms, it was said what I have heard. This is the evidence.

The questioner : Yes, may Allah reward you with good, O Shaykh.

The Shaykh : And beware of that.

The questioner : O Shaykh, O Shaykh.

The Shaykh: Yes.

The questioner : I understand this, O Shaykh. WhenThe Shaykh : Ali Hasan said it, I was convinced as soon as he told me public utilities. I said, well, okay. But when I raised this problem to the brothers, they said to me, where does he get the evidence? And he brought me a hadith, and he said, I do not remember this hadith that he brought, meaning his evidence. So he said, this hadith, by Allah, I do not remember it, O Shaykh. This brother uses it as evidence for the permissibility that this profit is for charity or for seeking knowledge.

The Shaykh : Fine, what is behind this statement, may Allah guide you?

The questioner: Yes.

The Shaykh : What is behind this statement?

The questioner : O Shaykh, one of the brothers raised this problem for me, and he said some of the brothers, the owner of this money, presented it to him, and a student of knowledge wants to go to Yemen to seek knowledge.

The Shaykh : We have nothing but what I have heard, and peace be upon you.

The questioner: Yes.

The Shaykh : We have nothing but what I have heard, and peace be upon you.

The questioner : O Shaykh. O Shaykh.

The Shaykh : And peace be upon you.

The questioner : O Shaykh, I am convinced by this statement.

The Shaykh : There is no power and no strength except by Allah. Did you not hear the peace be upon you?

The questioner : Yes, I hear it.

The Shaykh : Yes, return the greeting.

The questioner : And upon you be peace, and the mercy of Allah and His blessings.

The Shaykh : There is no power and no strength except by Allah. People imagine that all knowledge is what Allah said, what the Messenger of Allah said. As for the understanding of the religion, they do not know it. Yes. Shuqara: O our Shaykh, the understanding of the religion.

The Shaykh : Yes. Shuqara: The understanding of the religion without a book or a Sunnah...

The Shaykh : This is correct. Shuqara: And therefore, when they hear that the understanding of the religion is derived from the general principles and the comprehensive fundamentals and the general evidences and implications, people are surprised.
