Q1: A man was sleeping next to his wife after his suhur meal in Ramadan. The imam's recitation, amplified by the loudspeaker in the mosque, was confused to him, so he thought it was the Tahajjud prayer and did not clarify whether it was the Fajr prayer or Tahajjud. He had intercourse with his wife, and he was able to turn on the light and check the clock, but he did not do so. After the intercourse, it became clear to him that it was the Fajr prayer. Is this considered being among those who are negligent regarding the sanctities of Allah and belittling their status? Does he have to repent, and what is required of him, given that he is in the deepest regret over what he did?
A1: If the situation is as described, that he had intercourse with his wife after the dawn broke in Ramadan while believing that the night was still remaining, then there is no sin on you for that, because you did not intentionally have intercourse during the day of Ramadan. However, you and your wife must make up the day on which the intercourse occurred, and you must pay the expiation for intercourse during the day of Ramadan, which is freeing a believing slave. If you do not find one, then you must fast for two consecutive months. If you are unable to do so due to old age or illness, then you must feed sixty poor people. Your wife must pay a similar expiation if she was willing, but if she was coerced, then she is only required to make up that day. You must make sincere repentance for this act and not be negligent in this matter, by being cautious in verifying whether the dawn has broken or not after you get up from your night prayer, so that you do not invalidate your fast. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
