A man had intercourse with his wife before dawn and continued until the call to prayer

Fatwa number ( 17542 )
Q: On the 28th of Ramadan, after the pre-dawn meal, I had intercourse with my wife. After I finished, the call to the dawn prayer was made, and I do not know whether the intercourse occurred during the night or after the dawn prayer.
Did the intercourse take place during the night or after the Fajr prayer?
Therefore, I want your ruling: Do I have to fast that day, or is the expiation alone sufficient?

A: If a man has intercourse with his wife during the day in Ramadan, or if he has intercourse at night and the act continues into part of the day, as appears from the description in the question, then he must make up the fast and pay the expiation. The expiation is freeing a believing slave; if he cannot find one, then fasting two consecutive months; and if he cannot do that, then feeding sixty poor people. The wife is absolutely required to make up the fast in this case, and the expiation is required of her if she was willing and not coerced. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
